Tek taraflı ekonomik tedbirler ve uluslararası yatırım hukukunun ilişkisi

Abstract

Modern uluslararası hukukta, devletler tarafından, diğer bir devletin gerçekleştirmekte olduğu bir uluslararası haksız fiili sona erdirme ve uluslararası sorumluluğa ilişkin yükümlülükleri yerine getirme amacı ile tek taraflı ekonomik tedbirler uygulamaya koyulmaktadır. Devletler tarafından uygulamaya koyulan tek taraflı ekonomik tedbirlerin hukuka uygunluğuna ilişkin tartışmalar bulunmaktadır. Ayrıca, bu tedbirler, zaman zaman yalnızca sorumlu devletleri etkilemek ile kalmayıp, tedbirleri alan devletlerin ülkeleri üzerinde faaliyet gösteren ve sorumlu devletin uluslararası haksız fiiline katkıda bulunmakta olan yabancı yatırımcıları da hedefleyebilmektedir. Alınan bu tedbirler, uluslararası yatırım hukuku kapsamında mevcut olan yabancı yatırımcıları koruma standartlarının ihlalini teşkil edebileceğinden, yatırımcılar, yatırımcı-devlet uyuşmazlık çözüm mekanizması kapsamında yatırım tahkimine başvurabilecektir. Yatırım tahkimi sonucunda, hakem heyeti tarafından, yatırımcı lehine tazminata hükmedilebilecek ve bu durum, tek taraflı ekonomik tedbirleri etkisiz hale getirebilecektir. Bunu engellemek adına, ev sahibi devlet de çeşitli savunmalar ileri sürebilecektir. Ev sahibi devlet tarafından gerçekleştirilebilecek savunmaların hukuka uygunluk teşkil edip etmeyeceğine ilişkin olarak ise mutabakat bulunmamaktadır. Bu çalışma kapsamında, ev sahibi devlet tarafından gerçekleştirilebilecek savunmaların hukuki analizinin gerçekleştirilmesi amaçlanmıştır.

In modern international law, unilateral economic measures are adopted by states in order to put an end to an internationally wrongful acts committed by other states and to comply with the obligations arising out of international responsibility. The legality of the unilateral economic measures, however, are disputed. Moreover, these measures, sometimes, not only affect the responsible states, but also target foreign investors who are contributing to the internationally wrongful act of the responsible state, operating in the territory of the states taking the measures. As these measures may constitute a breach of the foreign investor protection standards available under international investment law, foreign investors may resort to investment arbitration under the investor-state dispute settlement (ISDS) mechanism. As a result of the investment arbitration, the arbitral tribunal may award compensation in favor of the investor, which may render the unilateral economic measures ineffective. In order to prevent such a scenario, the host state may raise various defences. There is no consensus as to whether the defenses that may be raised by the host state would constitute compliance with the law. Within that scope, this study intends to conduct an analysis on the legality of the defences that may be invoked by the host state.
