SES VE GÖRÜNTÜ NAKLEDİLMESİ YOLUYLA DURUŞMA İCRASI (HMK m.149)

Abstract

Ses ve görüntü nakledilmesi yoluyla duruşma icrası, HUMK da yer almayan fakat 6100 sayılı HMK m.149 ile ilk defa hukuk hayatı- mızda giren yargılama usul işlemidir. Duruşmaların ses ve görüntü nakli yoluyla icrası ile mahkeme, tarafların rızası olmak koşuluyla taraflara ve vekillerine bulundukları yerden duruşmalara katılmalarına ve usul iş- lemleri yapmalarına izin verebilir. Yine bu yöntem ile tanığın, bilirkişinin, uzmanın veya bir tarafın başka bir yerden dinlenebilmesi mümkün olabilecektir. Hukukumuzda bu yolla duruşmaların icrasının UYAP üzerinden Segbis sisteminin veya benzeri sistemlerin kullanılması ile mümkün olacağı HMK Yönetmeliğinin 60. maddesinde belirtilmektedir. Hukukumuz açısından henüz çok yeni olan bu sistemin nasıl ve hangi kapsamda uygulama alanı bulacağını zaman gösterecektir, fakat davaların kısa sürede sonuçlanması için teknolojik imkânların elverdiği ölçüde kullanılması gerekmektedir.The administration of trials via digital technology did not exist in the previous Code of Civil Procedure Law but has been introduced for the first time in the new Civil Procedure Law No. 6100. Using these technologies, the testimony of witnesses, experts, court experts or other third parties can be possible. Art. 60 of the Civil Procedure Law provides that the execution of trails by this method shall be administered with Segbis over UYAP or a similar system. It will take time to determine how and in which context this system will be used. However, technological systems and methods could potentially reduce the length of the trial period.
