Publication: Parlamenter sistemde devlet başkanının cezai mesuliyeti
Abstract
Devleti temsil eden, çeşitli görev ve yetkilerle donatılmış devlet başkanı, hangi sisteme bakarsak bakalım devletin en önemli unsurlarından birini teşkil etmektedir. Modern devlet anlayışı öncesi yönetme yetkisini ilahi haklara dayandıran devlet başkanlarının dünyevi sorumluluğu bulunmamaktaydı. Fakat modern devlet yetki ile birlikte mesuliyet kavramını da devlet başkanı için gündeme getirmiştir. Çalışmamız kapsamında parlamenter sistemde devlet başkanının cezai mesuliyeti karşılaştırmalı hukuk ve doktrindeki görüşlerle ortaya konularak, 1982 Anayasası özelinde inceleme yapılmaya çalışılmıştır.
Head of state, who is equipped with various duties and powers, constitutes one of the most important elements of the state, regardless of which system we looks at. There was no earthly responsibility of heads of state who based their authority on divine rights on pre-modern state understanding. But modern state has brought the concept of accountability with authority to head of state. Within the scope of our work, the criminal responsibility of head of state in the parliamentary system was put forward by the opinions of the comparative law and doctrine, and an examination was made in accordance with the 1982 Constitution.
