Taksitle satış sözleşmesinde cayma hakkı

Abstract

Günümüzde çok farklı satış politikaları sayesinde cazip fırsatlar oluşturularak tüketim özendirilmektedir. Taksitle satış sözleşmesi de bazı özellikleri sebebiyle tüketimin özendirilmesi amacıyla kullanılan bir sözleşme türüdür. Tüketici bu satış politikalarından etkilenmekte, ihtiyacı olmamasına rağmen satış ilişkisine girebilmektedir. Düşük taksit bedelleri başlangıçta cazip geldiği için sözleşme ilişkisine dahil olmaktadır. Ancak bir süre sonra ağır bir yükün altına girdiğini fark ederek sözleşme ilişkisine son vermek istemektedir. Kanun koyucu tüketicinin korunması amacıyla tüketiciye sözleşmeden cayma hakkı tanımıştır. Cayma hakkı tüketiciye yeniden düşünme imkanı sağlayarak sözleşme ilişkisine son verebilme imkanı sağlamaktadır

Recently, consumption is becoming attractive and encouraged by force of different sale policies. Further, hire purchase agreement, as a result of some features, is a kind of agreement which is used to encouraged the consumption. Consumer is influenced by different sale policies and make a sale agreement even though it is not of need. Low instalment rates can be attractive at the begining and included into the contractual relationship. However, after a short period, consumer realises that he is under a big pressure and wants to withdraw from the agreement. In order to protect the consumer, legislator has recognized the right of withdrawal from the agreement. Right of withdrawal provide opportunity to consumer to reconsider and enable him to withdraw from the agreement.
