Medeni yargılama hukukunda usule ilişkin nihai kararlarda yargılama giderlerinden sorumluluk

Abstract

Adalet hizmetinin yürütülmesinde devletin bu hizmetten yararlananlardan talep ettiğiparasal katkılar yargılama giderlerini oluşturmaktadır. İncelemenin temel konusunu, hukuk mahkemelerince verilen usule ilişkin nihai kararlarda yargılama giderlerinden sorumluluk oluşturmaktadır.Çalışmamızda medeni yargılama hukukunda usule ilişkin nihai karar çeşitleri, bu kararlarda yargılama giderlerine ne şekilde hükmedileceği, 6100 sayılı HMK, Yargıtay içtihatları ve doktrindeki görüşler kapsamında incelenmiştir.

The main purpose of thisstudy was to constitue the responsibility of the judicial costs in the procedural finaljudgement givin by çivil courts. In this study, the sort of procedural final judgements inCivil Procedural Law, how judicial costs will be judged in these judgements are analyzedwithin the contex of the Code of çivil Procedure Numbered 6100, Supreme Court practices and the doctrine of judgements.
