Fıkıh Usulü'nde Lafzi Karine ve delalet üzerindeki etkisi

Abstract

“Fıkıh Usûlünde Lafzî Karîne ve Delalet Üzerindeki Etkisi” adlı çalışmamız, şer’i naslardan ictihad yoluyla hükümlerin çıkarılması amacıyla bu nasların yorumu ve anlaşılmasında azami öneme sahip olan lafzî karineler konusunda yapılmış olan ilk çalışma özelliğini taşımaktadır.Çalışmamızın birinci bölümünde “lafzî karine” kavramı, tanımı, çeşitleri, benzer usül kavramlarıyla ilişkileri ele alınmış, usulcülerin eserlerinde lafzî karîneyi inceleme yöntemlerine işaret edilmiştir. İkinci bölümde ise şer’i naslarin anlaşilmasinda lafzî karinelerin etkisi ana başlığı altında lafzî karînelerin emir-nehiy mutlak –mukayyed ve amm-has lafızları açıklamadaki rolü, açık (zâhir) ve kapalı (hafî), hakikat ve mecâz lafızların delaletleri üzerindeki etkisi ile lafızların hükümlere olan delaletindeki rolleri ele alınmıştır. Ayrıca lafzî karinenin nasların yorumundaki işlevleri zikredilerek tüm bu konular Kur’ân ve sünnet naslarından örnekler vererek uygulamalı bir şekilde araştırılmıştır.Sonuç bölümünde ise fıkıh usulünde lafzî karine konusunda ulaşılan bilgi ve tespitlere yer verilmiştir.

This study, entitled “Literal Presumption (Qarinah) and its effect on the Indication (Dalalah)” is considered to be the first study dedicated to the fundamental literal presumption, which has a great importance in interpreting and understanding the legal texts and comprehending them to extract the judgments by the an independent opinion.The first chapter of the study was devoted to illustrate the concept of the literal presumption and its origin, its sections, and its relation to some of the similar fundamental terms and mentioning how the fundamentals scientists talked about the literal presumptions in their writings. In the second chapter, I talked about the impact of the literal presumption in understanding the legal texts by showing their effect on the impacts in the semantics of the imperative clause, the prohibition, the general, the private, the absolute, the restricted contexts, the hidden and clear texts. In this chapter I also discussed the impact of the literal presumption in truth and the metaphor and its impact on the methods of semantics over the sentences in addition to the functions of the literal presumption. Allof this has been dealt with in this study with special interest in mentioning practical examples extracted from the Holy Quran and Sunnah. The study ended with the conclusion of the most important results reached.
