KANUNLARLA KORUNAN BASIN ÖZGÜRLÜĞÜNE VURULMUŞ PRANGALAR; SANSÜR VE OTOSANSÜR

Abstract

Bu makalede basın özgürlüğü, bireye ait ifade ve düşünce özgür- lüğünün toplum ile temas noktası olarak incelenmiştir. Söz konusu irde- leme yapılırken ise, temel haklar çerçevesinde sınırlamalarda gözetil- mesi gereken orantı ve ölçülülük ilkeleri vurgulanmıştır. Öyle ki, temel hakların sınırlanmalarında hakkın sert çekirdeğine dokunulması halinde, artık o hakkın varlığından bahsedilemeyeceği kabul edilir. Çalışmanın devamında ise, basın özgürlüğüne getirilen sınırlamalardan sansür ve - belki de en tehlikeli sınırlama olan- oto-sansür olgularına değinilmiştir. Bu perspektifteki çıkış noktamız ise medya kurumlarındaki “patronaj” gerçeği olmuştur.

This article is about freedom of press more specifically about the freedom of expression as a point of contact with the community. In addition, the proportional limitations of such right is highlighted in this article. In fact, in the event the right of freedom of pres is completely limitated, such right could be considered as unexisted. This article also studies the restrictions, and censorship on the freedom of press, in addition to the (more probably the most dangerous) cases of self- censorhip the reason behind such dangerous self-sencorship is in fact the “patronage”.
