Abstract
Bu araştırmada, sağlık hakkı ve bu hakkın korunması için oluşturulmuş, sağlık sistemleri, bu sistemlerden ortaya çıkmış yasalar, bu yasalardan doğmuş sorumluluklar ve sağlık hizmetlerinin durumu incelenmiştir. Araştırmanın ikinci bölümünde, sağlık kavramına yer verilmiştir. Bu kavram altında, sağlığın tanımı yapılmış, sağlığın ölçülmesinin yaratacağı olumlu sonuçlardan bahsedilmiş ve sağlık sistemlerinin yapıları, işleyişi, ülke örnekleriyle birlikte karşılaştırmalı tablolar halinde sunulmuştur. Ayrıca, sağlık hakkının önemi ve bu hakkın, ulusal ve uluslararası kaynaklarla bazı ülke anayasalarında ne kadar yer aldığı açıklanmıştır. Üçüncü bölümde, sağlık hakkı ve yaşama hakkının neler olduğu, bu hakkı korumak için, bireylerin, hekimlerin ve hastanelerin sorumlulukları, bu sorumlulukların yerine getirilmemesi halinde, ortaya çıkan hukuki durumları açıklanmıştır. Dördüncü bölümde, sağlık hizmetlerinin tarihçesi verilmiş, bu hizmetlerin örgüt yapısı ve bu yapı içindeki birimlerin görevleri anlatılmıştır. Sağlık hizmetlerinin durumu, ayrıntılı verilerle, karşılaştırmalı tablolar halinde sunulmuştur. Ayrıca on beş Avrupa ülkesindeki sağlık hizmetlerinin, durumu da verilmiş ve değerlendirmesi yapılmıştır. Yine sosyal güvenlik kuruluşlarının, özel sigortaların yaptıkları, sağlık yardımlarının çeşitleri ve kapsamı açıklanmış, sağlık güvencesi olmayan kesimlere ne gibi sağlık yardımları yapıldığı da ele alınmıştır. Beşinci bölümde, sağlık hakkını korumak için sunulan sağlık hizmetleri ve uygulamalarından doğan sorunları ve bu sorunlardan ortaya çıkan çözüm yolları, belirli başlıklar altında, maddeler halinde sıralanmıştır. Sorunların alternatif sistemle çözümü altında, genel sağlık sigortası ve tüm sigortaların tek bir çatı altında toplanma konusu açıklanmıştır. Altıncı ve son bölümde ise sonuç yazılmış ve tüm bölümlerdeki unsurlar özetlenerek, araştırma bitirilmiştir.
In this research the health systems which organized for health right and preserving the said rights, the acts occurred from those systems, responibilities revealed from the said acts and status of the health services have been examined. In the second chapter of the research the health concept has been examined. The description of the health has been realized under the said concept and it has been mentioned the positive results of the health measurement and it has been presented the struc- tures of the health systems and their operations whit country examples as in comparative tableaus. Also, it has been explained the importance of the health right and its porti- ons in the national and international sources and in some country constitutions. In the third chapter, it has been axplained about the concepts of health right and living rights and responibilities of the individuals, physicians and hospitals and legal status that occured in case that those responibilities have not been realized. In the fourth chapter, it has given the history of the health services and it has been explained the organizational structure of those services and duties of the units within this structure. The status of the health services has been presented with detailed data as in comparative tableaus. Also, the status of the health services in the fifteen European countries have been presented and evaluated. İt has been axplained the services of the social security institutions and private insurance companies, varieties of the health aids and their concepts also it has been focused on the sectors whose have no halth securities and types of health aids carried out towards those sectors. In the fifth chapter, the health services which provided in order to preserve the health right and problems which occurred from their applications and solution methods from those problems have been listed as in spesific headinds and articles. The subject of the general health insurance and collecting of all problems within a single heading under the concept of the solving the problems through alternative system. In the sixth and final chapter, the summary has been written nand the elements in all chapters have been summarized and the research has completed.
