Büyükşehirlerde Kararları Kim Alıyor? Büyükşehir Belediye Meclislerinde Temsil Sorunu ve Çözüm Önerileri

Abstract

Makalede büyükşehir belediye meclislerindeki temsil sisteminin yol açtığı so­runlar ve buna yönelik çözüm önerileri tartışılmaktadır. Türkiye'de BŞB meclisi üyeleri doğrudan seçimle değil, büyükşehir belediyesi sınırlan içinde yer alan belediyelerden gelen üyelerle oluşmaktadır. Bu durum meclis üyelerinin çift kimlikli olmasına dayalı olarak, BŞB meclislerinin büyükşehir bütününü göre­memesi sorununa yol açabilmektedir. BŞB meclisinin oluşumunda alt kademe­deki belediyelerin temel alınması, bir başka soruna daha yol açmaktadır. Temsil sistemi, aynı BŞB içinde yer alan belediyeler, arasında ciddi bir temsil adaletsizliği doğurmaktadır. Bu durum, 5216 sayılı yasayla çok daha çarpıcı bir boyuta ulaşmıştır. Temsil sistemi, küçük nüfuslu belediyelerin lehine sonuçlar doğur­maktadır. Oldukça küçük nüfuslu belediyelerin BŞB meclisinde sayısal olarak önemli bir ağırlığa sahip olmalan, büyükşehirlerde kararlan kim alıyor sorusu­nu anlamlı kılmaktadır. Bu ise yönetsel ve demokratik başka bir takım sorunlara yol açabilecek niteliktedir. Makalede temsil sorunu için kısa ve uzun vadeli çö­zümler önerilmektedir.

This, article discusses the problems arising from the representational system in the councils of metropolitan municipalities, and proposes solutions. In Turkey, the members of the councils of metropolitan, municipalities are not directly elected; the councils are formed from members of municipal councils within the boundaries of metropolitan municipalities. In this situation, members of the councils have a double identity, for this reason they do not visualize the city as a whole. This system causes inequitable representation of municipalities within the same metropolitan municipality system. With the hew law of Metropolitan Municipalities (Law No.52l6), this fact, hâs become more striking. The representation system produces outcomes in favor of municipalities with small population.. At this point, to ask the question of "who takes the decisions in metropolitan municipal councils?" is significant. This situation causes some administrative and democratic problems -together with others. This article proposes short and long-term solutions to the representation problem.
