İbn Nüceym'in er-Resail'indeki aile hukukuna ilişkin risalelerin tahkik ve tahlili

Abstract

İslam hukuk tarihinde el-Eşbâh ve'n-nezâir adlı eseriyle Mecelle'nin yazımına kaynaklık ederek önemli bir yer tutan ve döneminin en çok tanınan Hanefî fakihlerinden biri olan İbn Nüceym'in birçok risâlesi bulunmaktadır. Bu risâlelerin yazmalar arasından tespit edilerek literatüre kazandırılması, İbn Nüceym'in gerek İslam Hukukunun gelişimine olan katkısını gerekse de dönemindeki fıkhî problemleri ve bu problemlerin çözümüne dair uyguladığı yöntemleri görebilmek adına önem arz etmektedir. İbn Nüceym, tez kapsamında incelemiş olduğumuz kırka yakın risâlenin mecmua halinde oğlu tarafından birleştirildiği er-Resâilü'z-Zeyniyye fi fıkhi'l-Hanefîyye adlı eserde gerek kişinin yapması ve yapmaması gerekenlere dair ilmihal konularında, gerekse vakıflar, vekâlet, eşya hukuku gibi ictimai konularda gerekse de talak, nikâh ve evlilik gibi aile hayatına dair konularda dönemindeki problemlere ilişkin görüşlerini kaleme almıştır. Tez kapsamında genel olarak bu önemli risâlelerin tanıtımı yapılmış, özel olarak da İbn Nüceym'in aile hukukuna ilişkin risâlelerinin tahkik ve tahlili yapılarak konuya bakış açısı değerlendirilmiştir.

Ibn Nujaym, one of the most well-known Hanafi scholars of his period, has an important place in the history of Islamic law with his work named al-Ashbah ve'n-nezair as a source for the writing of Mecelle and he has other many untreated treatises. Identifying these treatises among the manuscripts and adding them to the literature is important in order to see the contribution of our famous author to the development of Islamic Law as well as the fiqh problems in his period and the methods he applied for the solution of these problems. Ibn Nujaym, in his work titled ar-Resailu'z-Zeyniyye fi fıkhî'l-Hanefîyye, in which nearly forty treatises we have examined within the scope of the thesis were combined by his son in the form of a magazine, he wrote about the issues of ilmihal about what a person should do and should not do, as well as on legal issues such as foundations, power of attorney, property law. He also wrote his views on the problems of his period on family life such as talaq and marriage. Within the scope of the thesis, these important treatises were introduced to the literature, and specifically, Ibn Nuceym's treatises on family law were investigated and analyzed, and the point of view on the subject was evaluated.
