Kurtarma sözleşmeleri

Abstract

Kurtarma, deniz hukukunun kendine münhasır özellikleri olan önemli bir kavramıdır. Kurtarma sözleşmesi, tehlike altında olabilecek gemi, yük ve/ veya diğer değerlerin güvenliğe kavuşturulması için, önceki bir hukuki ilişki gereğince söz konusu değerleri koruma yükümlülüğü altında bulunmayan bir kişi ile yapılan sözleşmedir. Tez çalışmamızda üç ana bölüm kapsamında kurtarma sözleşmesinin özellikleri ve kuruluşu, kurtarma sözleşmesinin hükümleri ve kurtarma sözleşmesinin sona ermesi ve uyuşmazlıkların çözümü hususları, uluslararası konvansiyonlar, uluslararası hukuk kuralları ile iç hukuk düzenleme ve içtihatları kapsamında incelenmiştir. Öğretideki tartışma ve görüşlere yer verilmiş ve uygulamadaki sorunlara değinilerek çözüm önerileri sunulmuştur.

Salvage is an important concept of maritime law with its own unique features. Salvage contract is a contract made with a person who is not under the obligation to protect the ship, cargo and/ or other values in accordance with a previous legal relationship in order to secure the said values that may be in danger. In our thesis, the characteristics and formation of the salvage contract, the provisions of the salvage contract, the termination of the salvage contract and the resolution of disputes were examined within the scope of international conventions, international law rules, domestic law regulations and jurisprudence. Discussions and opinions in the doctrine were included, the problems in practice were mentioned and solution suggestions were presented.
