Abstract
Yapı kayıt belgesi, “İmar Barışı Kanunu” olarak da adlandırılan, 3194 sayılı İmarKanunu’na eklenen Geçici Madde 16 ile hukuk literatürümüze girmiş yeni bir belge türüdür.Bu belgeyle, mali yükümlülükleri yerine getirilmeden yapılmış kaçak yapıların,kayıt altına alınması; kişiler ile Devlet arasında imar barışı yapılması amaçlanmıştır.Bu amaç doğrultusunda yapı kayıt belgesi alınabilecek yapıların kapsamı geniş; şartlarısınırlı tutularak beyan üzerine yapı kayıt belgesi alınmasına imkan tanınmıştır. Budurum, kanunun amacıyla uyumlu gözükse de, bilerek ya da bilmeyerek yanlış uygulamalarınortaya çıkmasına neden olabilecek niteliktedir. Bu yanlış uygulamaların herbiri hukuki problem çıkarmaya adaydır. Bu ihtimali azaltmak veya sorun çıktığındayol gösterme adına çalışmada, yapı kayıt belgesinin alınma şartları, hukuki niteliği,beraberinde getirdiği sonuçlar, iptali ile belgeye ilişkin izaha muhtaç diğer hususlarbütüncül bir anlayışla ele alınmıştır.
The building registration document is a new type of document that has been introduced to our legal literature further to Provisional Article 16, which has been added to Zoning Law No 3194, also known as the “Zoning Peace Law”. This document shall provide for the registration of buildings built in breach of financial obligations and in violation of the law; its purpose is to create a zoning amnesty between the people and the State. In line with this purpose the scope of buildings that can obtain a building registration document has been kept wide and under restricted conditions it provides the possibility of obtaining a registration document by declaration. Although this appears to be compatible with the purpose of the law, it may knowingly or unknowingly result in misapplication. Each misapplication is a candidate for creating legal issues. In order to reduce this possibility or to provide guidance when an issue arises, the conditions of obtaining a building registration document, its legal characteristic, results that accompany it, revocation and other matters that need clarification related to the document are considered with a holistic approach.
