Abstract

EŞLER ARASI SAYGININ SINIRLARI ve SECDE HADİSİ TAHKİK-TAHRİC-DEĞERLENDİRME Hz. Adem'le başlayan hayat serüveninde insan olma erdemiyle donatılmışken, insanoğlunun kontrol edilmeyince sapkınlaşan gurur-kibir-kendini beğenme ve yeterli görme gibi duygularının etkisiyle zamanla ikinci sınıf bir varlık hatta insan olup-olmadığı tartışılacak kadar insafsız uygulamalara maruz bırakılan kadın, şimdilerde toplum, hayatında varlığını hissedilir derecede arttırmıştır. İlâhî vahiyle unutkan olan insanlığa hatırlatılan güzelliklerin en kemâl şekli İslam vahyiyle tamamlanmıştır. Bu kemalin bir karesinde yer alan kadın ve ona dair telakkiler, kendisinden önceki portreleriyle karşılaştırılınca tüm güzelliğiyle gün yüzüne çıkmaktadır. Kur'an nassları ve Hz. Peygamber'in bizzat uygulamaları bu estetiğin güzel tablolarını bize sunmaktadır. Böyle bir sahnede, dönemin anlayışından varolan toplumun ileri gelenlerine abartılı/ aşırı bir ta'zimde bulunma, Hz. Peygamber tarafından kendisi de dahil olmak üzere bir varlık veya eşyaya gösterilmesini yasaklayarak sadece bu tür bir saygının gösterileceği merciin yaratıcı Rab olan Allah olduğu vurgulanmıştır. Yine Allah'ın yücelttiği hakkının büyüklüğüne rağmen kadından böyle bir saygıyı kocasına da göstermesi istenmemektedir. Hadisi doğru anlama ve onu diğer bir dile doğru aktarımındaki öncelik lafzî boyutuyla ve o toplumda bulduğu karşılığıyla ele alındıktan sonra ifadesindedir.Dolayısıyla hadisimizde yer alan Secde kelimesinin doğru karşılığının bulunması ve Lev Şart Edatı´nın kullanılma amacının doğru tespiti, hadisin yanlış anlaşılıp, akabinde üzerine yanlış hüküm bina edilmesi gibi bir hatadan bizi koruyacaktır. Çalışmamızda öncelikle hadisin kelimelerine dair bilgiler verilmektedir. Hadisin klasik ve günümüz eserlerindeki yerlerine değinilmekte, kadına ilişkin İslam öncesi telakkiler ile kadın-erkek ilişkileri, aile içindeki rol dağılımı, eşlerin sorumlulukları ve haklarına ilişkin konular İslam çizgisiyle yer almaktadır. Hadisin farklı lafızları, yer aldığı kaynaklar itibariyle sened ve metin tenkidine tâbi tutulmaktadır. LİMİTATİON OF REGARD BETWEEN COUPLES AND THE HADİTH SECDE RECOURSE TAHKİK-TAHRİC-EVALUATİON Woman who had been illuminated with the virtue of 'being mankind'in the adventure of life that started with Prophet Adam, became a creature from second class with the feelings' effects which were out of control such as pride, arrogance, conceitedness belonged to human being. Moreover woman was exposed to unmerciful applications up to be argued about whether she was a human or not. But nowadays woman increases her noticable existence in social life. The perfection of goodness which were reminded to forgetful human being with İLAHİ message has been completed with Islam's message. 'Woman and viewpoints on Woman' which takes place in one square of this perfection is brought to light by Islamic viewpoints with its beauty when it is compared with the portraits before it. The Quran NASS and Prophet Mohammad's applications show us the great pictures of this aesthetic. In this scene, to honour exaggeratedly and excessively to the notables of the term with that time's comprehension was prohibited by Prophet Mohammad stating that; to show an honour like that to an existent or propert or to Prophet Mohammad's himself was forbidden because th only recourse for that kind of honour could be creator Allah. Nevertheless though the husband's right is praised by Allah, an exaggerated respect towords the husband is not expected from tht wife. The impotance in understandig the hadith correctty and translating it in anotyer language is to translate that word with Lafzî dimension and with meaning used by that society. So the find of equivalent for word Prostrate in Prayer used in our Hadith and the correct determination of LEV ŞART EDATI's usage aim would protect us from misunderstanding of the hadith and from the fault of wrong verdict. In our work, information about the words of hadith is given firstly. The place of hadith in Classical Works & Today's Works is mentioned. And also the viewpoints on woman before Islam, male-female relations, duties in family life, the issues about responsibilities and rights of mates are mentioned with an Islamic stripe. The criticism on sened and metin (essay) is stated in the work according to the recourse which include the hadith's different utteraces.
