Bilirkişilik Kurumsallaşıyor Mu? Bilirkişilik Kanunu Kapsamında Bir Değerlendirme

Abstract

Yargılama hukukunda sıklıkla kullanılan delil türlerinden biri olan bilirkişilik müessesesinin eksikliklerini gidermek, uygulamadaki problemleri azaltmak amacıyla düzenlenen ve TBMM Genel Kurulunda kabul edilen "Bilirkişilik Kanunu", bu çalışmanın inceleme konusu yapılmıştır. Söz konusu Kanun ile bilirkişilik müessesesinin kurumsallaştırıldığı görülmektedir. Bu kurumsallaşmanın ve getirilen diğer düzenlemelerin etkin ve yeterli olup olmadığı çeşitli açılardan irdelenmekte ve somut çözüm önerileri ortaya konulmaktadır. Kanun'un yetersiz olduğu ya da eksik kaldığı hususlar çalışmada ifade edilmeye çalışılmıştır.

In this study, the "Expertness Establishment" which is one of the most frequently used types of evidence used in judicial proceedings, is analyzed according to new amendtment that was adopted in the General Assembly of the Grand National Assembly of Turkey (TGNA) and in respect to reduce the problems of practicing expertise. It is seen that expertness establishment is institutionalized. Whether or not this institutionalization and other regulatory reforms are effective and sufficient is examined from various aspects and concrete solution proposal is presented. The facts that were inadequate or missing were tried to be expressed in the study.
