Abstract
Terör, sosyal, ekonomik ve siyasi yönü bulunan, birçok açıdan değerlendirilmesi gereken bir durumdur. Dünyanın küreselleşmesiyle birlikte, sadece bulunduğu ülkenin meselesi olmaktan çıkmış ve tüm insanlığı tehdit eden bir sorun olarak uluslararası bir boyut kazanmıştır. 11 Eylül saldırıları sonrasında dünya kamuoyu ve hükümetlerinin bir numaralı gündem maddesi haline gelmiş olmasına rağmen uluslar arası alanda henüz ortak bir Terörizm tanımı bulunmamaktadır. Ortak bir tanımlamanın yapılamaması sorunun çözümünü daha da zorlaştırmaktadır. Özellikle ülkemizde yıllardır temel gündemi oluşturan konuların başında gelen, ülkemize vermiş olduğu maddi ve manevi zararın maliyeti tespit edilememektedir. Terörizmle mücadele edebilmenin ve terör örgütlerini etkisiz hale getirebilmenin en önemli başlıklarından biri terör örgütlerinin finansman kaynaklarının engellenmesidir. Terör örgütlerinin finansman kaynakları tespit edilerek bu kaynakların kurutulmasının önemi uluslararası toplum tarafından anlaşılmış ve bu konuyla ilgili birçok düzenleme yapılmıştır. Terör ve terör örgütlerinin finansman kaynakları ile elde edilen fonların transferi bu çalışmanın temel konusunu oluşturmaktadır. Diğer organize suç örgütleri ile benzerlik gösterse de terörün finansman kaynakları kendine has kimi özellikleri de bünyesinde taşımaktadır. Çalışmada, terör örgütlerinin fon kaynakları ve bu fonların transferi ile bu fon transferinin önlenmesine yönelik çalışmalar ortaya konulmaya çalışılmaktadır. Terror is a situation that has a social, economic and political sides, and that needs to be evaluated from many points. With globalization, it has went out of the boundaries of the country it is found, and has gained an international dimension that threats the whole humanity. Following the September Eleven Attacks, although it became the number one agenda of the world public opinion, terrorism has not a certain definition in the international arena. The abscence of a common definition makes the solution of the problem more difficult. The cost of the material and moral damage given by terror that has kept the prominent agenda in our country for years cannot be ascertained. One of the most important titles of struggling against terrorism and making it ineffective is the prevention of the fincancial sources of the terrorist organizations. The importance of determining the ficancial sources of terror organizations and obliterating them has been understood by the international community, and many regulations have been made about this topic. Terror and the transfer of the fonds obtained thourgh the ficancial sources of terror organization constitute the basic subject of this study. Though it has similarities with other crime organizations, the financial sources of terror have distinctive features as well. Within the study,the fund sources of terror organizations, the transfer of these funds and the studies to prevent the transfer of these funds have been tried to be revealed.
