Möhuk Madde 31 Bağlamında Türk Hukukunda Doğrudan Uygulanan Kurallara Bakış

Abstract

Sözleşme ile sıkı ilişki içerisindeki üçüncü bir devletin doğrudan uygulanan kuralları konusu 5718 sayılı yeni MÖHUK’un 31’inci maddesinde düzenlenmiştir. Bu düzenlemede Roma Konvansiyonu model alınmıştır. Ancak 5718 sayılı MÖHUK’un yürürlüğe girmesinden kısa bir süre sonra Roma I Tüzüğü Roma Konvansiyonu’nun yerini almıştır. Roma Konvansiyonu’nun üçüncü bir devletin doğrudan uygulanan kuralları konusunu düzenleyen maddesine getirilen eleştiriler dikkate alınarak, Roma I Tüzüğü’nün ilgili maddesinin düzenlemesinde esaslı bir değişikliğe gidilmiştir. Roma I Tüzüğü ile yapılan bu değişikliğin, 5718 sayılı MÖHUK’ta konuyu düzenleyen 31. maddede yapılmasına ihtiyaç olup olmadığı, bu makalede incelecektir.

Article 31 of MOHUK (The Code on Private International Law and Civil Procedure) sets forth the internationally mandatory rules of another state which are most closely connected to the contract. The article aforementioned is adopted from the Rome Convention whereas the Rome I Regulation has replaced the Convention. In consideration of the criticisms related to the article of the Convention stipulating direct applicability of another state’s rules, Rome I Regulation has introduced drastic changes in this regard. This article is an attempt to identify whether or not it is necessary to adopt the said amendment in terms of Article 31 of MOHUK.
