Türkiye ve Avrupa ülkelerinde zorunlu trafik sigortası sistemlerinin incelenmesi ve bir model önerisi

Abstract

Bu çalışma, Türkiye ile Avrupa’da seçilmiş beş ülke olan Almanya, Fransa, Hollanda, Polonya ve İtalya’daki zorunlu trafik sigortası uygulamalarını karşılaştırmalı bir analiz çerçevesinde incelemektedir. Çalışmanın temel amacı, Avrupa ülkelerindeki yasal çerçeveleri, fiyatlandırma yöntemlerini, denetim ve uygulama mekanizmalarını analiz ederek, Türkiye’deki mevcut sorunlara yönelik çözüm önerileri sunmaktır. Tez dört bölümden oluşmaktadır. İlk bölümde zorunlu trafik sigortasının önemi, kapsamı ve kuramsal temelleri ele alınmıştır. İkinci bölümde Türkiye’deki mevcut sistem detaylı şekilde incelenmiş, prim dengesizlikleri, yüksek hasar/ prim oranı, zarar eden bir branş olması, sigortasızlık oranları ve denetim eksiklikleri gibi yapısal sorunlara değinilmiştir. Üçüncü bölümde ise seçilen Avrupa ülkelerinin zorunlu trafik sigortası sistemleri analiz edilmiştir. Bu ülkelerde sigorta kapsamının genişletilmesi, mali sürdürülebilirliğin sağlanması, risk temelli fiyatlandırma yöntemleri ve teknolojik çözümler (kara kutular, kullanım temelli sigorta gibi) dikkat çekmektedir. Son bölümde, Avrupa ülkelerindeki başarılı uygulamalardan ilham alınarak Türkiye için pratik ve uygulanabilir bir model önerilmiştir. Bu modelde, adil bir prim sistemi oluşturulması, denetimlerin artırılması, merkezi bir veri sisteminin kurulması ve Güvence Hesabı gibi kamu destekli yapılarla sistemin daha sürdürülebilir hale getirilmesi hedeflenmektedir. Önerilen yapının, sigorta sisteminin daha dengeli işlemesine ve sigortalılık oranlarının artırılmasına katkı sağlaması beklenmektedir

This study presents a comparative analysis of compulsory motor third-party liability insurance practices in Türkiye and five selected European countries: Germany, France, the Netherlands, Poland, and Italy. The main aim of the study is to examine the legal frameworks, pricing methods, supervision, and enforcement mechanisms in these countries, and to propose solutions to the current problems in the Turkish system. The thesis consists of four main chapters. The first chapter discusses the importance, scope, and theoretical foundations of compulsory traffic insurance. The second chapter focuses on the current system in Türkiye, addressing structural problems such as premium imbalances, high loss-to-premium ratios, the unprofitable nature of the branch, a relatively high rate of uninsured vehicles, and weak enforcement. The third chapter analyzes the systems of the selected European countries, highlighting noteworthy practices such as broader insurance coverage, financial sustainability, risk-based pricing methods, and the use of technological solutions (e.g., black boxes and usage-based insurance models). In the final chapter, a practical and applicable model is proposed for Türkiye, inspired by successful implementations in Europe. The proposed model aims to establish a fair premium system, strengthen supervision, create a centralized data infrastructure, and ensure sustainability through public mechanisms such as the Guarantee Fund. It is expected that the proposed structure will contribute to a more balanced insurance system and help increase the rate of insured vehicles.
