Zina sebebiyle boşanma davasında hukuka aykırı deliller

Abstract

Tezimizin konusunu “Zina Sebebiyle Boşanma Davasında Hukuka Aykırı Deliller” oluşturmaktadır. Çalışmamız iki bölümden oluşmakta olup; ilk bölümünde zina kavramını, Türk Medeni Kanunu’nda zinanın ne şekilde düzenlenildiğine yer verilerek zina sebebiyle boşanma davasının özellikleri ve koşullarını, zina sebebine dayalı boşanma davası açma hakkının hangi durumlarda mümkün olmadığı, yargılaması ve ispatının ne şekilde olduğu, bu noktada hakimin rolunün ne olduğu irdelenmiştir. İkinci bölümde ise delil kavramı, zina sebebiyle boşanma davasında kullanılması mümkün olan ve mümkün olmayan deliller incelenerek, hukuka aykırı delillerin çerçevesi çizilmiş hukuka aykırı delillerin zina sebebiyle boşanma davasına yansımaları açıklanılarak çalışmamız tamamlanılmıştır.

The subject of this thesis is Unlawful Evidence in Divorce Due to Adultery.Our study consists of two chapters; In the first chapter, the concept of adultery was discussed in many points by how adultery is regulated in the Turkish Civil Code, the characteristics and conditions of the divorce case due to adultery, in which cases the right to file a divorce case based on the cause of adultery is not possible, what kind of judgment and proof is, and what is the role of the judge at this point.In the second chapter, our study was finalized and completed by explanation of the concept of evidence with several perspectives including the evidences that are possible and impossible to be used in divorce proceedings due to adultery, and the reflections of the unlawful evidences outlined in the divorce case due to adultery.
