Gizliliğin ihlali suçu (TCK m.285)

Abstract

Bu tezde Türk Ceza Kanunu’nun 285 inci maddesinde yer alan gizliliğin ihlali suçu incelenmektedir. Tez dört bölümden oluşmakta; birinci bölümde, gizlilik terimine, suç tipinin mukayeseli hukuktaki durumuna, diğer kanunlarda yer alan benzer hükümler ile TCK.’nunda düzenlenen benzer suç tiplerine temas edilmektedir. İkinci bölümde soruşturmanın gizliliğini ihlal suçu, suçun unsurları olarak kabul edilen tipiklik, maddi unsurlar, manevi unsurlar ve hukuka aykırılık unsurları başlığı altında değerlendirilmektedir. Üçüncü bölümünde kanuna göre kapalı yapılması gereken veya kapalı yapılmasına karar verilen duruşmadaki açıklama veya görüntülerin gizliliğini alenen ihlâl etme suçundan dördüncü bölümde ise, kişilerin suçlu olarak damgalanmalarını sağlayacak şekilde görüntülerinin yayınlanması suçundan bahsedilmektedir. hlali, basın yayın, soruşturma, aleniyet ve kanuna aykırılık.

In this thesis, the crime of breach of confidentiality, in the Article 285 of Turkish Penal Code is examined. The thesis consists of four parts: in the first section, it is glanced at the subject of the privacy term, the state of crime type in comparative law and other laws with similar provisions. In the second section, the crime of breach of confidentiality, the typicalnesses which are regarded as the crime elements, the material elements are investigated under the consideration of spritual elements and elements of unlawfulness. The third section is covered by the crime of violation to breach of confidentiality by publishing the pictures or explanations of the court trial which had to be done after close-doors. In the fourth section, the publication of images of people which will cause them to be labeled as criminals, is mentioned.
