MUVAZAALI ASIL İŞVEREN ALT İŞVEREN İLİŞKİSİNDE ALT İŞVEREN İŞÇİLERİNİN TOPLU İŞ SÖZLEŞMESİNDEN KAYNAKLI ZARARLARI VE TAZMİNİ

Abstract

Uygulamada muvazaalı alt işveren ilişkilerine sıklıkla rastlanmak-tadır. Muvazaa tespit edildiğinde, işçiler baştan itibaren tek ve gerçek işveren olan asıl işverenin işçisi sayılırlar. Bu durumda asıl işverenin taraf olduğu toplu iş sözleşmesinden geçmişe yönelik olarak yararlanma-ları gerekir. Ancak Kanun’un toplu iş sözleşmesinden yararlanmak için öngördüğü şartlar vardır ve taraf işçi sendikasına üyelik bunlardan biridir. İşçi muvazaa sebebiyle taraf işçi sendikasına üye olma şartını geç-mişte gerçekleştirmemişse o dönem bakımından uğradığı ekonomik bir zarar ortaya çıkar. Çalışmamızda, Kanun’a aykırı şekilde gerçekleştirilen muvazaa ile işçilerin haklarından yoksun bırakılmasının hukuki olarak engellenmesinin mümkün olduğu açıklanacaktır.

Collusional relations in subcontracting are frequently occured in practice. When collusion is detected, workers are considered to be the workers of the principal employer, who is the sole and real employer from the beginning. In this case, they should benefit retrospectively from the collective bargaining agreement to which the principal employer is a party. However, there are some conditions stipulated by the Law to be- nefit from collective labor agreement and being a member of the cont- racting labor union is one of those conditions. If the employee has not fulfilled the condition of being a member of the labor union, due to col- lusion, then it means that there is an economic loss of the worker’s for that period. In our study, it will be examined that how the damage cau- sed by this illegal situation can be eliminated.
