FAZLA ÇALIŞMA ÜCRETİNİN AYLIK ÜCRETE DÂHİL EDİLMESİ

Abstract

Fazla çalışma ücretini aylık ücrete dâhil eden sözleşme kayıtlarına son yıllarda daha sık rastlanmaktadır. Bununla birlikte, aylık ücreti fazla çalışma dâhil eden sözleşmelere sınırlı bir etki tanınmakta ve aylık ücretin ancak azami yasal fazla çalışma süresi karşılığı fazla çalışma ücretini içerebileceği kabul edilmektedir. Ayrıca fazla çalışma ücretini içeren aylık ücret belli bir tutara ulaşmalı ve işçiden yazılı onay alınmalıdır. Fazla çalışmanın aylık ücrete dâhil edilmesinde hangi araçların (iş sözleşmesi, işyeri uygulaması, personel yönetmeliği ve toplu iş sözleşmesi) kullanılabileceği ise diğer bir tartışma konusudur.
