Publication: Emek piyasalarında işsizlik sigortası
Abstract
Bu çalışma üç bölümden oluşmaktadır. Yaptığımız bu araştırma işsizlik ve işsizlik sigortasının teorik çerçevesinin ortaya konmasıyla başlamaktadır. Çünkü, asıl konumuz olan işsizlik sigortasının hukuki yönden incelenebilmesi için ilk önce teorik temellerinin anlaşılması gerekir. Bu bölümde ele alınan kavramları çeşitli yönleriyle tanıtmaya çalıştık. İkinci bölümde AB ülkelerinde uygulanan işsizlik sigortası programını anlatmaya çalıştık. Çünkü, Türkiye bu alana daha yeni adım atmaktadır. Türkiye'deki durumu anlatmadan önce bu sahaya girmiş olan ülkelerde durum nedir? Yani, işsizlik sigortası gerçekten ortaya çıkan işsizliğin tazmininde ne gibi rol oynamaktadır. Üçüncü ve son bölümde ise Türkiye'deki işsizlik sigortası kanununu incelemeye çalıştık. İşsizlik sigortası çalışma istek ve yeteneğinde olmasına karşın kendi iradesi dışında işini kaybedenlerin işsiz kalmaları nedeniyle uğradıkları gelir kaybını belirli bir süre ve ölçüde karşılamayı amaçlayan bir sigorta dalıdır. Devlet tarafından zorunlu katılım ilkesine göre kurulmakta ve sigortacılık tekniği ile faaliyet göstermektedir. Sosyal tarafların hiçbirini memnun etmese de, işsizlik sigortası yasası ile Türkiye'de ileri bir adım atılmıştır. Buna karşılık, 4447 Sayılı Yasa sosyal sigortaların örgütsel olarak yeniden yapılanması için gerekli reform beklentilerine yanıt verebilmiş değildir. Özellikle fon işletmeciliği ve idari özerklik konularında ileri bir adımın atıldığı görülmemektedir. Yasama açısından da bir takım eksikliklere bakmayarak bu kanunun çıkmasıyla uluslar arası sözleşmelere de uyulmuş olarak, sosyal güvenlik zincirini tamamlamaya yönelik çok önemli bir adım da atılmış oldu.
Unemployment is one of the most significant problems causing social depressions in many countries. Mainly two different aspects are faced with while combating this problem. One of them is the prevention of unemployment and the other is the compensation of the income losses due to unemployment. İn this study we tried to examine the later one, unemployment insurance programmes. This study has three chapters. To be able to examine the main subject of our study, legal frame of unemployment insurance, we need to understand its theoretical bases. So, in the first chapter we tried to bring up theoretical frame of unemployment itself and unemployment insurance. İn this chapter we aimed to introduce different aspects of the subject. İn the second chapter unemploument insurance programmes which are carried out in EC countries were explained. Before explaining recent situation, in Turkey, we wanted to display the most experienced countries' states in this area. İn this chapter we tried to give examples of unemployment insurance programmes and their positive effects on unemployed people. We wanted to give answers to this question: What is the effects of unemployment insurance on compensating income losses due to unemployment? İn the last chapter the unemployment insurance programme in Turkey was examined.
