İslam fıkhında ehliyet arızalarının ibadetlere etkisi

Abstract

İSLÂM FIKHINDA EHLİYET ÂRIZALARININ İBADETLERE ETKİSİ İslam Fıkhı’nda ehliyet arızalarının ibadetlere etkisi fıkıh usulü ve fur’û fıkıh kaynaklarında dağınık bir şekilde ele alınmış, ve bu alanda ihtiyaca cevap verir mahiyette bir çalışma, eser ortaya konmamıştır. Bu çalışmamızın amacı da mevcut olan bu eksikliği gidermek, konu ile ilgili derli toplu bir çalışma ortaya koymaktır. Bu yapılırken de öncelikle, ehliyet arızaları semâvî ve müktesebe şeklinde olmak üzere iki ana bölüm altında ele alınmıştır. Semâvî Arızaların ibadetlere etkisi başlığı altında; akıl hastalığı, bunama, bayılma, uyku, hastalık, küçüklük, unutma, ölüm, ay hali, lohusalık gibi haller işlenmiştir. Mükteseb Arızaların ibadetlere etkisi başlığı altında ise sarhoşluk, sefihlik, yolculuk, cehalet, hata ve gayr-i ciddî davranmak gibi haller incelenmiştir. Semâvî ve mükteseb arızalar vücûb ehliyetini kaldırmamakta ancak, edâ ehliyeti açısından birtakım özel durumları ortaya çıkarmaktadır. Ayrıca, ehliyet arızalarının hepsinin de ibadetleri aynı derecede etkilemediği görülmektedir. Çalışmamızda da ehliyet arızalarının ibadetlere ne derecede etki ettiği ortaya konmuştur.

“EFFECT OF EFFECİENCY DEFECTS TO WORSHİPS İN ISLAMİC LAW” The theme of “Effect of effeciency defects to worships in Islamic Law” is not dealt in sourches of Islamic Jurisprudence and Law in a collected/ organized shape and there hasn’t been a work and a study which responds the need in this area. The aim of our study is to cover this blank and to present a sound work relating this topic. In our study we devided the effects of effeciency defect into two: unprevrentible and prevrentible defects. In the part of “the effect of unpreventible effeciency defects to worships” we took up topics such as madness, senile, fainting, sleep, illness, childhood, forgetting, death, menstruation, childbirthing. In the part of “the effect of preventible effeciency defects to worships” we took up topics such as drunkenness, extravagancy, journey, ignorance, mistake, laxity. These unprevrentible and prevrentible defects don’t cease effeciency of deserve, but they introduce some special matters in the effeciency of obligation. Furthermore, all of these defects are not equal in their effects. Our study is on the degree of effectiveness of effeciency defects to worships.
