Türk Ceza kanunu Kapsamında hakaret suçu

Abstract

Bireyin maddi varlığı gibi manevi varlığı da hukuken korunmalıdır. Bu nedenle insanın yalnızca insan olmasından dolayı sahip olduğu şeref varlığı da hukuki koruma kapsamındadır. Türk hukuk sisteminde bireyin şeref varlığı Anayasamızda, Türk Medeni Kanunu’nda ve Türk Borçlar Kanunu’nda korunduğu gibi ceza hukuku yaptırımları ile de korunmaktadır. Bireyin onur, şeref ve haysiyetine yönelik saldırıları koruma altına almak amacıyla 5237 sayılı Türk Ceza Kanunu’nda hakaret suçu öngörülmüştür. Tezimizin konusu 5237 sayılı Türk Ceza Kanunu’nun ikinci kitabının “Kişilere Karşı Suçlar” başlıklı ikinci kısmının “Şerefe Karşı Suçlar” başlığını taşıyan sekizinci bölümünde düzenlenen hakaret suçudur. Çalışmamız iki ana bölümden oluşmaktadır. Birinci bölümde hakaret suçu hakkında verildikten sonra suç ile korunan hukuki değer ve suçun unsurları anlatılmıştır. İkinci bölümde ise suçun özel görünüş şekilleri, cezayı azaltan veya kaldıran haller, soruşturma ve kovuşturma usulü ve yaptırım ele alınmıştır. Bunun yanında TCK’da düzenlenen özel tahkir suçları çalışma kapsamımızın dışında olup hakaret suçu ile ilişkilendirilebildiği oranda değinilmiştir. Yine TCK m.130’da düzenlenen kişinin hatırasına hakaret suçu yalnızca mağdur alt başlığı altında incelenmiştir.Hakaret suçunu düzenleyen normun çerçevesinin kesin olarak çizilememesi uygulamada muğlaklık yarattığından tezimizde sık sık hakaret suçuna ilişkin Anayasa Mahkemesi kararları, Yargıtay kararları ve Avrupa İnsan Hakları Mahkemesi içtihatlarından yararlandık. Söz konusu kararlar ile neyin hakaret suçu oluşturup neyin oluşturmayacağını somutlaştırarak konuyu anlaşılır kılmayı amaçladık.

Just like the material existence of the individual, its spiritual existence should also be protected by law. For this reason, the honor that a person has just because he is a human is also within the scope of legal protection. In the Turkish legal system, the honor of the individual is protected by criminal law sanctions as well as in Constitution, Turkish Civil Code and Turkish Code of Obligations. In order to protect the attacks against the honor, dignity and pride of the individual, the crime of defamation is stipulated in the Turkish Penal Code numbered 5237.The subject of our thesis is the offense of defamation in the eighth chapter of the second part titled Crimes Against Persons of the second book of the Turkish Penal Code numbered 5237, Crimes Against Honor. Our study consists of two main parts. In the first part, after giving general information about the defamation crime, the legal value protected by the crime and the elements of the crime are explained. In the second part, special appearance forms of the crime, situations that reduce or abolish the punishment, investigation and prosecution procedure and sanctions are discussed. In addition, the special defamation crimes regulated in TCK are out of the scope of our study and have been mentioned as much as they can be associated with the defamation crime. Again, the crime of insulting the memory of the person regulated in article 130 of the TCK has been examined only under the subtitle of the victim.The fact that the framework of the norm regulating the defamation crime cannot be drawn precisely creates ambiguity in practice, we have frequently made use of the Constitutional Court decisions, Supreme Court decisions and the European Court of Human Rights in our thesis. With these decisions, we aimed to make the subject understandable by concretizing what constitutes a defamation crime and what does not.
