Abstract
Demokrasi ve hukuk devletinin gerçek manada işleyişi ve yansıması, kendisini özellikle “hak arama” özgürlüğü çerçevesinde gösterir. Bu husus, yargılama hukukunda, mahkemeye intikal etmiş hukukî uyuşmazlığın başlangıç ve bitiş noktasının belirlenmesini zorunlu kılmaktadır. Çalışmamızın konusu olan ara kararın sınırlarını oluşturmak, nihai karar kadar kolay olmamaktadır. Farklı ve değişik ihtimallerde ara kararın ihdası, mezkûr hususu zorlaştırmaktadır. Uygulamada, özellikle ve çoğunlukla verilen ara kararlar, çalışmamızın kapsamını belirlemede ölçüt olarak kullanılacaktır. Türk yargılama hukukunda; ara kararın sınıflandırılması, yargılama hukukunun temel ilkeleriyle değerlendirilmesi, bazı kurumlarla irdelenmesi ve özellikle pratikte ayrı bir önemi haiz olan ara karardan dönme ile ara karara karşı kanun yolu, çalışmamızın temeli niteliğindedir. Bunun yanında, karşılaştırmalı hukuk açısından ara kararı incelememiz, Türk yargılama hukukuna perspektif kazandırması açısından önemlidir. Ara kararın niteliğinin ortaya konması, kendisini özellikle ara karara karşı kanun yoluna müracaatta göstermektedir. Mehaz ve Mukayeseli hukukta, ara kararın kanun yoluna taşınması; makul sürede yargılamanın bitirilmesi, usul ekonomisi ilkesi ve hak arama özgürlüğü dengesinde işlenmektedir. Bu dengenin, Türk yargılama hukukunda var olan güncel ara karara ilişkin sorunların çözümüne katkı sunup sunamayacağı önem arz etmektedir.
The real functioning and reflection of democracy and the rule of law manifests itself especially within the framework of the freedom to seek rights. This issue necessitates the determination of the starting and ending point of the legal dispute that has been submitted to the court in the law of jurisdiction. Creating the boundaries of the interlocutory judgement, which is the subject of our study, is not as easy as the final judgement. The creation of an interlocutory judgement in different and various possibilities complicates the aforementioned issue. In practice, interlocutory judgements, especially and mostly, will be used as a criterion in determining the scope of our study. In Turkish judicial law; The classification of the interlocutory judgement, its evaluation with the basic principles of the trial law, its examination with some institutions, and especially the reversal from the interlocutory judgement, which has a separate importance in practice, and the the right to appeal the interlocutory judgement are the basis of our study. In addition, our examination of the judgement in terms of comparative law is important in terms of giving perspective to Turkish judicial law. Revealing the nature of judgement shows itself especially in the application to the the rights to appeal the interlocutory judgement. Carrying out the rights to appeal the interlocutory judgement in conventional and comparative law; The completion of the trial in a reasonable time is handled in the balance of the principle of procedural economy and the freedom to seek justice. It is important whether this balance can contribute to the solution of the current interlocutory judgement problems in Turkish judicial law.
