Abstract
Bu çalışma, farklı ülkelerden 14 Şer'i Kurulu üyesiyle gerçekleştirilen mülakatlara dayanarak, İslami finans alanında standartların belirlenmesi sürecinde karşılaşılan zorlukları incelemektedir. Bu zorlukların araştırılması amacıyla beş hipotez oluşturulmuş ve bu hipotezleri test etmek üzere nitel araştırma yöntemi benimsenmiştir. Mülakat yapılan kişilerin ortak özelliği, İslami bankacılık sistemleri denetiminde görev alarak, işlemlerin İslam hukukuna uygunluğunu denetleyen ve değerlendiren uzmanlardır. Araştırma kapsamında yarı yapılandırılmış mülakatlar gerçekleştirilmiş ve her biri hipotezleri kapsayan toplam sekiz soru yöneltilmiştir. Sorular, İslami finans standartların oluşumuna etki eden iç ve dış faktörleri analiz etmeye yöneliktir. Bu kapsamda hükümet politikaları, kültürel farklılıklar ve fıkhi yorum çeşitliliği gibi temel etkenler incelenmiştir. Araştırma bulguları, uzmanların karşılaştığı sorunları ortaya koyarak, İslami finans standartların daha etkili bir şekilde geliştirilmesine katkı sunmayı amaçlamaktadır.
This research investigates the challenges encountered in the process of determining standards in Islamic finance by conducting interviews with 14 members of Shariah Boards from various countries. To explore these challenges, five hypotheses have been formulated. A qualitative research methodology has been adopted for this study. One of the key criteria for selecting interviewees is their expertise in Islamic banking, particularly their role in Sharia boards by establishing Islamic financial systems and ensuring compliance of financial transactions with Shariah principles. The interviews were conducted in a semi-structured format, allowing in-depth insights to be collected. The interview questions—eight in total—were carefully designed to address the hypotheses and examine both internal and external factors influencing standard-setting in Islamic finance. For example government policies, cultural differences, the diversity of Islamic jurisprudence (fiqh) and other factors. The findings of this study aim to shed light on the practical difficulties faced by Shariah scholars and offer recommendations that can support the development and enhancement of more effective Islamic financial standards.
