Galâvî’nin Butlayhiyye Adlı Manzum Eseri Işığında Mâlikî Mezhebinde Fetva Usulü

Abstract

Mâlikî mezhebinde fetva usul ve âdâbını ilgilendiren meseleler, geç dönemlerde müstakil eserlerde ele alınmış ve bu eserler mezhebin fıkıh usulü ve fetva kitaplarından bağımsız yeni bir yazım türünün doğmasını sağlamıştır. Bu tezde, modern öncesi İslâm tarihinin son dönemlerinde yaşamış Galâvî’nin (ö. 1245/ 1828) Butlayhiyye adlı manzum eseri ışığında Mâlikî mezhebinde yerleşik hale gelen fetva usul ve âdâbı bahse konu edilmiştir. Galâvî’nin nazmı, Mâlikîlerin özellikle müteahhir devirde cumhur görüşü haline gelen yaklaşımlarını yansıtması sebebiyle temsil gücü yüksek bir metin olduğu için tercih edilmiştir. Muhtelif eserlerde dağınık vaziyette işlenen konuları veciz ve sistematik bir şekilde nazım haline getiren ve bu sayede müftîler için bir el kitabı hüviyeti elde eden Butlayhiyye, fetva usulü konusunun önde gelen kaynaklarındandır. Çalışma, bir giriş, üç bölüm ile sonuç kısımlarından oluşmaktadır. Giriş kısmında çalışmanın kaynakları, araştırmada takip edilen yöntem ve tez boyunca kullanılan belli başlı kavramlar sunulmuştur. Galâvî’nin hayatı ve içinde yetiştiği ilmî çevre tanıtılmış, ilmî çalışmaları analiz edilerek kendisinin bu alandaki yetkinliği incelenmiş ve nazmın içeriği, yöntemi ve kaynakları araştırılarak Mâlikî mezhebi ve hususen fetva usûlü literatüründeki yeriyle ilgili tespit ve değerlendirmelere yer verilmiştir. İkinci Bölüm’de müftî ve müsteftînin sahip olması gereken özellikler, müftî-müsteftî ilişkisini düzenleyen esas ve şartlar üzerinden fetva usul ve âdâbının öne çıkan yönleri ele alınmıştır. Üçüncü Bölümde ise iftâ sürecinin işleyişi ve mezheb içinde fetvaya esas olan (müftâ-bih) görüşün belirlenme süreci ve bu süreçte riâyet edilmesi gerekli kural ve ilkeler konu edilmiştir.

Issues of fatwa methodology and ethics in Mālikī school of law have been covered in separated works in a late era. This works generated a new literature that is independent from the legal theory (usūl al-fiqh) and legal opinion (fatwa) sources. This thesis deals with the fatwa methodology and ethics in Mālikī school of law by the example of Ghalāwī, who lived in premodern and in the late era of Islamic History (1245/ 1828) and his poetry named Butlaihiyya. It was preferred to choose a text, that has a high representative power because it presents the generally accepted meanings of the last era Mālikī scholars. Themes, that have been covered in differently works in a scattered way, were determined in a short and systematically poetry. So Butlaihiyya becomes a handbook for the muftis and one of the important works in the fatwa-methodology literature. This thesis consists of one introduction, three chapters and a conclusion. The introduction is about the thesis sources, methods and the most important terms. The first chapter is about the life of Ghalāwī and his intellectual environment where he grown up. His intellectual works and profession in this field have been analyzed. Content, method and sources of the poetry have been researched and his position within the Mālikī school of law and fatwa methodology literature have been evaluated. The second chapter is about the characteristics of the muftī and mustaftī and the principles and conditions that regulate the relationship between the muftī and mustaftī. The third chapter deals with the process of iftā and the rules and principles for the determining of the fatwa meaning (muftā-bih).
