Rükneddin es-Semerkandi'nin Telhisu Camii'l-Usul adlı eserinin tahkik ve tahlili

Abstract

Bu çalışma, 701 H. yılında vefat eden Rükneddin Ubeydullah es-Semerkandi'nin fıkıh usulü ilminde Telhisu Camii’l-usul adlı kitabının tahkik ve tahlilidir. Emir ve nehiy, icma, kıyas ve ictihad gibi usul-i fıkhın konularını ve her bir konuda mezheplerin delillerini kısa ve öz olarak sunuyor. Bu kitapta, Rükneddin es-Semerkandi'nin çok sayıda nakil yoluyla Fahreddin er-Razi'den etkilendiği görülmektedir. Bu kitap, aynı yazarın iki cilt halinde basılan Camiu’l-usul fi beyani kavaidi’l-hanefiyye ve’ş-şafiiye fi usuli’l-fıkh adlı kitabının kısaltılmış halidir. Bu çalışma iki bölüm halinde düzenlenecektir. İlk bölümde yer alacak konular: İlk olarak Rükneddin Ubeydullah es-Semerkandi’nin adı, nesebi, hayatı ve eserleri yer alacaktır. İkinci olarak Telhisu Camii’l-usul adlı eserin muhtevası, ilmî önemi, usulü'l-fıkh kitapları arasındaki yeri, fukaha ve mütekellimin metotlarını bir araya getirmedeki metodu incelenecek, Hanefi mezhebi ve diğer mezheplerin usul-i fıkıh kitaplarıyla bir mukayese yapılacaktır. Üçüncü başlıkta ise kitaptan bazı meseleler seçilerek usul-i fıkhın esasları, referansları ve ana kaynakları ışığında detaylı olarak incelenecektir. Dördüncü başlıkta, kitabın incelenmesinde izlenen yöntem ve kitabın bilimsel katkısı hakkında tartışma yapılacaktır. İkinci bölüme gelince, (تلخيص جامع الأصول) adlı eserin tahkiki başlığı altında, kitabın elyazmalarına başvurularak metninin incelenmesi, düzeltilmesi ve aslına uygun hale getirilmesine çalışılacaktır. Tezin önemi; fıkıh usulü kurallarının mukayese edilerek incelenmesinde ve bu konuda birçok kitap yazan Maveraünnehir âlimlerinden birinin bu konularla ilgili görüşlerini ortaya koymasında yatmaktadır. Bu nedenle, bu kitap usulü-l fıkıh kurallarını ve tarihi gelişimini incelemek isteyen herkes için bir referans olacaktır. Kanaatimizce bu kitap ilim dünyasının istifadesi için ilmi kurallara uygun biçimde yayımlanmaya layıktır.

This thesis is a critical edition and analysis of a book of Talhis Jami’i’l-Usul by Ruknuddin Ubaydullah as-Samarkandi, who died in 701 AH, in the science of jurisprudence. In addition to his briefing on the issues of the science of jurisprudence, and his brief presentation of the evidence for each group (mazhab) in each issue it appears in the book that as-Samarkandi was influenced by Fakhr al-Din al-Razi with his many quotes about him. This book is an abbreviation of a book of the same author, entitled: Jami’u’l-Usul fi Bayan Kawaid al-Hanafiyya wa as-Shafiiyya, which is printed recently in two volumes. My work on the book will be arranged in two parts. The first section will include several topics: Rukn al-Din Ubayd Allah al-Samarkandi: his name, lineage, life, writings etc. In the second topic, the book Talhis Jami’ al-Usool will be studied in terms of its content, its scientific importance, its place among the books of Usul al-Fiqh, the method of author in combining the two methods of the Mutakallim and Hanafi, and a comparison with other books of Usul al-Fiqh. In the third topic, some issues will be selected from the book and studied in a detailed scientific study in the light of the rules of jurisprudence, its references and main sources. In the fourth topic, the discussion will be about the method followed in this analysis and scientific output of the book. As for the second section, it came under the title: The Critical Edition of (تلخيص جامع الأصول), in which the text of the book will be reviewed, with the proper care for it for investigation, correction and scrutiny. The importance of the thesis lies in its subject matter and the status of the book investigated in the science of the principles of jurisprudence, in addition to the fact that it reveals a scientific aspect of one of the from the scholars of Transoxiana scholars who authored many books in various sciences. Therefore, it is worthy of this book to be edited, analysed, printed and published for the benefit of the world of science and its people to be a reference for everyone who wants to study the science of the principles of jurisprudence.
