İSTİHSAN METODUNUN KÂSÂNÎ'NİN BEDÂİU'S-SANÂİ' ADLI ESERİNDE KULLANILIŞININ TAHLİLLİ TENKİDİ Çeşitli gerekçelere dayanılarak teamülün dışında hüküm verme olarak özetlenebilecek istihsanın İslam Hukuk literatürüne bir metot olarak girmesi erken dönem Hanefi fakihler tarafından gerçekleşmiştir. Hukuka açılım sağlaması ve hukukta hakkaniyetin korunması açısından önemli bir yere sahip olan istihsan metodunu, Hanefi mezhebi fıkıh kaynakları arasında seçkin bir yere sahip olan ve Kâsânî'nin kaleme aldığı Bedâiu's-sanâi adlı eserde inceledik. Müellif usul eserlerinde zikredilen anlayış ve uygulamaya paralel olarak istihsanı eserinin pek çok yerinde kullanmıştır. Bu bağlamda istihsanın usul ve füru bakımından örtüştüğü görülmektedir. Ayrıca usul eserlerinde pek zikredilmeyen ya da genel olarak söz edilen bazı gerekçeleri de müellifin istihsana mesnet olarak kullandığı görülmektedir. In terms of ıts providing an expansion for the law and the preservation of justice, the Istihsan method has an important place in Islamic Law. I have studied this method in the book called Bedâiu's-sanâi written by Kâsânî which has a distinguished place among the sources of Muslim jurisprudence. In parallel to the insight and the practice mention in the studies of The Bases of Law, the auther used Istihsan in many places of his book. In view of these facts, Istihsan conforms with the fundamentals and subdivisions of a science. It has been seen that Kâsânî utulized some arguments, not mentioned in the books like the bases of law or generally alluded to them, as a support to Istihsan.
