Abstract
Toplu iş sözleşmelerinin yorumu, yorum dava-larının yanında normatif hükümlere dayalı alacakdavalarında uyuşmazlık konusu olmaktadır. Topluiş sözleşmesinin yorumunda borç doğurucu ve nor-matif hükümler ayrımı önem taşır. Borç doğurucuhükümler sözleşme gibi yorumlanırken, normatifhükümlerin yorumunda farklı bir yaklaşım benim-senmektedir. Normatif hükümler öncelikle objek-tif sözel yoruma tabi tutulmalı, bu yöntem sonuçvermediği takdirde tarafların ortak iradesi araştırıl-malıdır. Normatif hükümlerin yorumunda son çareolarak işçi lehine yorum yöntemi de uygulanabilir.
Interpretation of the collective agreements has been a matter of dispute in personal actions based on normative clauses along with the interpretation suits filed by the trade union or the employer. The distinction between normative clauses and obligatory clauses is crucial in relation to the interpretation of the collective agreement. Obligatory clauses are interpreted as contracts while a different approach has been adopted in the interpretation of the normative clauses. Normative clauses should be primarily subjected to an objective literal method. In case this method fails, common will of the contractants should be searched. The principe of interpretation in favour of the employee can be applied as a last ressort in the interpretation of the normative clauses
