Türk ceza kanununda bı̇r yaptırım türü olarak hapı̇s cezası ve tarı̇hsel gelı̇şı̇mı̇

Abstract

“Türk Ceza Kanununda Bir Yaptırım Türü Olarak Hapis Cezası ve Tarihsel Gelişimi” isimli bu çalışmada cezanın amacı bağlamında bir yaptırım türü olarak hapis cezası ve tarihsel süreç içerisindeki gelişimi incelenmiştir.Çalışmamızın birinci bölümünde yaptırım kavramı ve çeşitleri incelenmiş, Türk Ceza Kanunundaki düzenlemelere yer verilmiştir. Ceza kavramının tarihi seyri, yaptırım türü olarak cezanın yerindeliği tartışılmış, Türk Ceza Kanunu bağlamında cezanın amacı açıklanmıştır. Devamında ise hukukumuzdaki ceza çeşitlerine yer verilmiş, güvenlik tedbiri ile ceza arasındaki farklar belirtilmiştirÇalışmamızın ikinci bölümünde ise hapis cezasının geçirdiği aşamaları anlamak amacı ile Türk Ceza Kanununa kaynaklık etmesi bakımından hapis cezasının Osmanlı Devleti ve İslamiyet’teki yerine değinilmiş, hapisten önce tarih sahnesinde yerini alan zindan kavramı üzerinde durulmuştur. Günümüz sisteminde hapis cezası türleri anlatılarak hapis cezasının leh ve aleyhindeki görüşlere değinilmiştir.Sonuç kısmında ise hapis cezasının yaptırım türü olarak yerindeliği ve geçirdiği aşamalar hususunda kanaatimize yer verilmiştir.

In this study named “Prison Sentence and Historical Development as a Type of Sanction in Turkish Penal Code”, the sentence as a type of sanction and its development within the historical process are examined.In the first part of our study, the sanction plan and its types are examined and the regulations in the Turkish Penal Code are included. The historical course of the concept of punishment and the relevance of the punishment as the type of sanction were discussed. In the following, the types of punishments in our law are given and the differences between the security measure and the punishment are stated.In the second part of our study was to understand the stages of imprisonment aim of the Turkish Penal Code of the Ottoman Empire imprisonment terms to the source and are mentioned instead of in Islam, focused on its place in the stage of history before the jail space concepts dungeon.In today's system, the types of prison sentences were explained and the views against the pros and cons of the prison sentence were addressed.In the conclusion part, our conviction is considered as a kind of sanction for the imprisonment.
