Zorunlu askerlik hizmetinin iş ve sosyal güvenlik hukukuna etkisi

Abstract

Zorunlu askerlik hizmeti, erkek Türk vatandaşların vatani hizmetlerini yerine getirmesi için silahaltına alınmaları olarak tanımlanmaktadır. Her ne kadar bu kurum iş ve sosyal güvenlik hukuku ile ilgili olmasa da etki ve sonuçları dikkate alındığında iş ve sosyal güvenlik hukuku açısından değerlendirilmesi gerekmektedir. Bu kurum ülkemizdeki birçok vatandaşı ilgilendirmekte olup, uygulamada belirsizliklere sebep olabilmektedir. Tezimizde askerlik hizmetinin dokunduğu, iş sözleşmesinin feshi, işverenin ücret borcu, iş güvencesi, işverenin askerden dönen işçiyi yeniden işe alma yükümlülüğü, yıllık ücretli izin hakkı, kıdem tazminatı, eşit davranma borcu, sendika üyeliğinin askıya alınması ve etkisi, sosyal sigorta ve genel sağlık sigortası, işsizlik sigortası ve son olarak askerlik borçlanması ayrıntılı olarak incelenmiştir.

Mandatory military service is defined as the recruitment of male Turkish citizens to perform their national service. Although this institution is not related to labor and social security law, it should be evaluated in terms of labor and social security law when its effects and results are taken into account. This institution concerns many citizens in our country and may cause uncertainties in practice. In our thesis, the military service is touched, the termination of the employment contract, the employer's wage debt, job security, the employer's obligation to re-employ the worker who has returned from the military, the right to annual paid leave, the severance pay, the debt of equal treatment, the suspension of union membership and its effect, social insurance and general health insurance, unemployment insurance and finally military debt are examined in detail. We wanted to bring a collective work related to our subject to the academic community.
