Abstract
Bu tez, Osmanlı İmparatorluğu döneminde, miladi 16. ve 17. yüzyıllarda Filistin’de yaşamış ve müftülük görevinde bulunmuş olan Hayreddin er-Remlî'nin İslam hukuku ve Hanefi Mezhebi içindeki yerinin tespiti ve tez kapsamında tahkiki yapılan Risaleleri bağlamında fıkhi yaklaşımlarını ve düşüncesini ortaya çıkarmak amacıyla hazırlanmıştır. Tezin inceleme bölümünde Remlî’nin geniş bir tanıtımı yapılarak ismi, künyesi, lakabı ve nesebi, doğum-ölüm yeri ve tarihi, ilmî hayatı, hocaları ve talebeleri, ilmi seyahatleri, eserleri zikredilmiş, alimlerin onun hakkındaki görüşleri ve İslam hukukuna katkıları aktarılmıştır. Tahkik bölümünde ise Hayreddin er-Remlî’nin değişik fıkhi konularda kaleme aldığı on adet risâlesi ilmi kriterlere uygun olarak tahkik edilmiş, ilim dünyasına kazandırılan bu risâlelerin müellifin kaleminden çıkmış haline ulaşılmaya çalışılmış, bunun yanında inceleme kısmı ve dipnotlarda okuyucuya metni anlamada kolaylık sağlayacak gerekli açıklamalar yapılmıştır.
This thesis was prepared with the aim of determining the place of Khair al-Din al-Ramli, who lived in Palestine during the Ottoman Empire in the 16th and 17th centuries and served as a mufti, in Islamic law and the Hanafi school of thought, and to reveal his jurisprudential approaches and thoughts in the context of his treatises (Rasail), which were examined within the scope of the thesis. In the examination section of the thesis, a detailed introduction of Ramli was made, his name, identities, nicknames and lineage, place and date of birth and death, scientific life, teachers and students, scientific travels, works were mentioned, and scholars' views on him and his contributions to Islamic law were conveyed. In the verification section, ten treatises written by Khair al-Din al-Ramli on various jurisprudential subjects were verified in accordance with scientific criteria, and an attempt was made to reach the author's version of these treatises, which were brought to the scientific world, and in addition, necessary explanations were made in the review section and footnotes to facilitate the reader's understanding of the text.
