Abstract
Tüzel kişiliği haiz uluslararası bir aktör olarak AB uluslararası arenada uluslararası hukuk kurallarına göre hareket etmekte, uluslararası anlaşmalar akdederek taahhütler vermektedir. Devlet dışı bir aktör olarak AB’nin en temel amaçları uluslararası toplumdaki yerini kalıcı olarak güçlendirme ve Avrupa entegrasyonunu arttırmaktır. Özerklik ilkesi içsel ve dışsal yönleri ile Avrupa entegrasyonunda farklı yoğunluklarda ön plana çıkmıştır. Nitekim 1990'lı yıllardan sonra AB'nin uluslararası düzlemde artan ve genişleyen faaliyetlerinin tetiklediği AB hukuk düzeninin anayasallaşmasıyla birlikte, ABAD içtihatlarında ve literatürde özerkliğin dışsal boyutu ön plana çıkarılmıştır. Dış hukuki ilişkilerde özerklik ilkesi AB hukuk sisteminin temel özelliklerini güvence altına almak için bir manevra alanı olarak kullanılmaktadır. AB’nin giderek artan uluslararası ilişkiler ağına dahil olması ile akdedilen uluslararası anlaşmaların AB Antlaşmaları’na uygunluğunun değerlendirilmesi önem taşımaktadır. Uluslararası hukuk ile AB hukuku arasındaki dengeyi bulma ve AB hukukunu uluslararası hukuktan gelebilecek müdahalelere karşı koruma görevi ABAD’a aittir. Bu çerçevede uluslararası uyuşmazlıkları çözmek üzere kurulan uluslararası mahkemelere karşı ABAD’ın münhasır yargı yetkisinin bütün boyutlarıyla analizi önem arz etmektedir.
As an international actor with a legal personality, the EU acts in the international arena in accordance with the rules of international law and makes international commitments by concluding international agreements. The main aims of the EU as a non- state actor, are to permanently strengthen its place in the international community and to increase the European integration. The principle of autonomy, with its internal and external aspects, has come to the fore in different intensities in the European integration. As a matter of fact, with the constitutionalization of the EU legal order triggered by the increasing and expanding activities of the EU at the international level after the 1990s, the external dimension of autonomy was came to the fore in the ECJ jurisprudence and in the literature. The principle of autonomy in external legal relations is used as an area of maneuver to secure the fundamental features of the EU legal system. It is significant to evaluate the compliance of international agreements which were concluded with the EU's involvement in the ever-increasing network of international relations, with the EU Treaties. The task to find the balance between international law and EU law, and to protect EU law against any interference arise out of international law belongs to the CJEU. In this context, it is significant to analyze all aspects of the ECJ's exclusive jurisdiction against the international courts established to resolve international disputes.
