Çağdaş dönemde İslâm hukukçularının mülkiyet kavramına yaklaşımları

Abstract

Bu çalışma, çağdaş dönemdeki İslâm hukukçularının mülkiyet kavramına yaklaşımlarını konu edinmektedir. Bu dönemde, siyasi ve toplumsal kurumlarda yaşanan dönüşümlerin yanında dinî konu ve meseleler etrafında da yoğun tartışmalar yaşanmıştır. Bu konulardan biri olan mülkiyet, hak ile ilişkisinden dolayı önceleri Batı’da bazı tartışmalara konu olmuş ve bu tartışmalar bir süre sonra İslâm dünyasını da etkilemiştir. Bu çalışma, mülkiyet kavramı etrafında yaşanıp İslâm dünyasına muhtelif kanallardan taşınan tartışmaların çağdaş dönemdeki İslâm hukukçularına yansımasını incelemektedir. Çalışmada, Fransız kamu hukukçusu Leon Duguit ile Mısırlı İslâm hukukçusu Senhûrî arasındaki irtibat üzerinden mülkiyetle ilgili bazı tartışmalar ele alınmıştır. Mülkiyet kavramı hakkında genel olarak “sosyal fonksiyon” yönüne yoğunlaşan Duguit ve ondan etkilendiği varsayılan Senhûrî’nin çağdaş dönemdeki diğer İslâm hukukçuları ile ilişkileri de çalışmada incelenmiş ve bu dönemdeki İslâm hukukçularının mülkiyetle alakalı temayüllerine değinilmiştir. Yaşanan tartışmalar ve ortaya çıkan temayüller içinde öne çıkan “sosyal fonksiyon” kavramının Arap dünyasındaki bazı kanunlara nasıl yansıdığı da çalışmada izi sürülen meselelerden olmuştur.

This study deals with the approaches of Islamic jurists to the concept of property in the contemporary period. In this period, besides the transformations in political and social institutions, there were intense discussions around religious issues. One of these issues, property, has been the subject of some debates in the West due to its relationship with right, and these debates have also affected the Islamic world after a while. This study examines the reflections of the debates around the concept of property, which were carried to the Islamic world through various channels, on the contemporary Islamic jurists. In the study, some discussions about property are discussed through the connection between the French public jurist Leon Duguit and the Egyptian Islamic jurist Senhûrî. The relations between Duguit, who focused on the concept of property in general on the social function aspect, and Senhûrî, who is assumed to be influenced by him, with other Islamic jurists in the contemporary period were also examined in the study and the tendencies of the Islamic jurists in this period regarding property were mentioned. How the concept of social function, which stands out among the discussions and emerging trends, is reflected in some laws in the Arab world has been one of the issues traced in the study.
