Abstract
zelleştirme, Kamu İktisadi Teşekkülü, Özelleştirme Kanunu ÖZELLEŞTİRME VE İŞ SÖZLEŞMESİNE ETKİSİ ÖZET Ülkemizde ilk defa 1986 yılında uygulanmaya başlanan özelleştirme uygulamalarına ilişkin olarak bir çok yasal düzenleme yapılmış ve özelleştirmenin çalışanlara olan olumsuz etkilerini bu yasal düzenlemelerle önlenmeye çalışılmıştır. Ancak her ne kadar önlenmeye çalışılmış olsa da uygulamada sorunlar ortaya çıkmış ve uyuşmazlıklar yargıya intikal etmiştir. Çalışmamızın ilk bölümünde özelleştirmenin tanımı yapılmış, yöntemleri belirtilmiş, Dünya’dan örnekler ve Türkiye’deki yasal düzenlemeler anlatılmıştır. İkinci bölümde ise özelleştirmenin iş sözleşmelerinin feshine ve feshinden sonra olan etkisi gerek öğreti gerekse Yargıtay içtihatları ışığında incelenmiştir. Several legal regulations have been made in relation with privatization applications, which started in 1986 in our country for the first time, to prevent the negative impact of the privatization on the laborers. Although attempts were made to prevent the problems, several problems have arisen in the application and conflicts were submitted to the courts. In the first part of our work, the privatization is defined and its methods are described , examples of privatization from the world are cited and the regulation in Turkey is explained. The second part deals with the effects of the privatization on the termination of employment contracts and its effects after termination are examined both in the light of the doctrine and jurisprudence of the Supreme Court.
