Abstract
Günümüz itibarıyla bilgi paylaşımının gücü ve hızı gün geçtikçe artış yönünde büyük bir ivmelenme kazanmaktadır. Bilgi paylaşımının olduğu alanda bilgi düzensizliklerinin olması da kuvvetle muhtemeldir. Bu kapsamda Türk Hukukunda geçmişte yansımaları olan “halkı yanıltıcı bilgiyi alenen yayma suçu” ihdas edilmiştir. Çalışma kapsamında birinci bölümde bilgi ve bilgi düzensizliklerine değinilmiştir. Ardından çalışma konusu suç, gerçeğe aykırı bilgiyi cezalandırılan ülkelerdeki normlar ile kıyas edilerek benzer ve farklı yönlerine dikkat çekilmiştir. Hukukumuzdaki benzer suç tipleri ile kıyaslamaları yapılarak suçların birbirlerinden ayrılan yönleri incelenmiştir. İkinci bölümde çalışma konusu suç, tipiklik bağlamında ele alınarak unsurları irdelenmiştir. İfade özgürlüğüne ise ayrıca yer verilerek suç tipinin uygulama aşamasındaki muhtemel hak ihlali oluşturacak sebepleri irdelenmiştir.
As of today, the power and speed of information sharing is gaining a great acceleration in the direction of increasing day by day. It is highly likely that there will be information irregularities in the field of information sharing. In this context, “the crime of publicly disseminating misleading information”, which has had reflections in the past, has been introduced in Turkish Law. Within the scope of the study, information and information irregularities are mentioned in the first section. Then, the crime subject to the study was compared with the norms in countries that punish false information, and its similar and different aspects were pointed out. By making comparisons with similar types of crimes in our law, the aspects of the crimes that differ from each other are examined. In the second part, the crime subject of the study is examined in the context of typicality and its elements are analyzed. Freedom of expression is also given a separate place and the reasons that will constitute a possible violation of rights in the application phase of the crime type are examined.
