Rethinking the debates around sahifat al-medina in the light of constitutionalism, pluralism and consociationalism

Abstract

Türkiye’de 1990’lı yıllarda yoğun şekilde kamuoyuna İslamcı düşünür, akademisyen ve entelektüellerce taşınan Medine Vesikası tartışmaları bu tezin ana konusunu oluşturmaktadır. İslam tarihinde Medine döneminin başlarında ortaya çıkan bu metnin Türkiye kamuoyunda gündeme gelmesi temelde anayasalcılık ve çoğulculuk bağlamında gerçekleşmiştir. Bu tartışmaların temeline bakıldığında, din ve ideoloji itibarıyla farklılaşan toplumsal kesimlerin anayasal düzlemde kendi değer ve pratikleri çerçevesinde nasıl eşit ve özgür vatandaşlar olarak var olabilecekleri temellendirilmeye çalışılmıştır. Özellikle, 1990’lı yılların başlarında 1982 Anayasasını değiştirmeye yönelik çalışmalar ışığında, Medine Vesikası yeni bir toplumsal sözleşme üretecek çoğulcu bir anayasa modeli olarak değerlendirilmiştir. Bu bağlamda, tartışmaların, anayasalcılık ve çoğulculuk teorileriyle ilişkili olduğu görülmektedir. Bu doğrultuda çalışma, bahsedilen Medine Vesikası tartışmalarını anayasalcılık ve çoğulculuk teorileri üzerinden değerlendirecek ve bir tarihi olgu olarak Medine Vesikası’nın çoğulcu bir anayasa için zemin olabilme imkanını tartışacaktır. Medine Vesikası’nın tarihsel süreçte nasıl algılandığı ele alınarak algılanış biçimindeki dönüşümler incelenecek ve 1990’lı yıllarda Türkiye’deki tartışmalarda kazandığı yeni anlam analiz edilecektir. Bu yeni anlamın metodolojik tutarlılığı tartışılacak ve 1990’lı yıllarda vurgulanan anayasalcılık ve çoğulculuğun ötesinde bu teorileri kapsayan oydaşmacılık düşüncesinin Medine Vesikası için yeni bir teorik açılım sunma imkânı ele alınacaktır.

The main theme of this thesis is the debates on the Sahifat al-Medina, which was heavily publicized by Islamist thinkers, academics, and intellectuals in Türkiye during the 1990s. This document, which emerged at the beginning of the Medina period in the history of Islam, came to the fore in Turkish intellectual circles, mainly in the context of constitutionalism and pluralism. Looking at the center of these discussions, thinkers sought to justify the possibility of the existence of religiously and ideologically diversified social segments of society as equal and free citizens by conserving their own values and practices in the pluralist constitutional framework. At this juncture, within the context of constitutional change attempts for the 1982 Constitution at the beginning of the 1990s, Sahifat al-Medina is considered a novel social and political model. In this context, the present study aims to assess the discourse surrounding Sahifat al-Medina, through the lenses of constitutionalism and pluralism. Accordingly, this study will discuss the possibility of Sahifat al-Medina to be a ground for a pluralist constitution. An examination of the historical reception and evolving interpretations of the Sahifat al-Medina will be conducted, with a specific focus on the new meanings attributed to it during the discussions in 1990s Türkiye. Furthermore, the study will critically analyze the methodological coherence underlying this new interpretation. Beyond the predominant emphasis on constitutionalism and pluralism in the 1990s, the investigation will consider the prospect of a novel theoretical framework that incorporates these theories, namely consociationalism, as a means to comprehend Sahifat al-Medina.
