Abstract

Toplumların gelişmişlik seviyeleri fertlerinin mutlulukları ile ölçülür. Bir toplumun mutluluk endeksi yükseldikçe o toplumun refah ve medeniyeti seviyesi yükselmiş olur. Bunun için toplumun bütün bireylerinin mutluluk seviyelerinin yükselmesi gerekir. Bu yüzden toplumların zayıf halkalarını oluşturan kesimlerin mutluluğu için bütün toplumun gayret göstermesi lazımdır. Hastalar toplumu oluşturan en zayıf halkalardan biridir. Bu kesimin mutlu olabilmesi ise haklarını eksiksiz elde etmeleri ile bir nebze olsun temin edilmiş olacaktır. Bu nedenle hasta hakları, toplumun gelişmişlik ve medeniyet seviyesini göstermesi açısından önemlidir. Bu haklar hasta lehine bütün topluma karşı dinen, ahlaken ve hukuken korunmuş haklardır. Development level of the societies is measured with the happiness of its individuals. The more happiness index of a society increases, the higher social welfare and civilization level develops. To achieve this, it is required to improve happiness level of all individuals of the society. Thus, entire society should strive for the happiness of the parts representing weak links in the chain of society. Patients represent one of the weakest link in the chain. Happiness of this segment of the society may be partially ensured through enabling them to enjoy the patient rights in complete. Therefore, patient rights are especially important in that they indicate the development and civilization level of a society. Such rights are rights in law, ethics and religions in favor of the patient against entire society. This study aims to depict the patient rights from the perspective of Islamic Law.
