Hadis usulü açısından Şeybani ile Şafii’nin mukayesesi

Abstract

Hicrî II. asır İslâmî ilimlerin ve özelde hadis ilminin teşekkül edip gelişmeye başladığı bir dönemdir. Bu zaman dilimi müctehid imamların yaşadığı bir asır olması sebebiyle özellikle hadis ve fıkıh ilimleri açısından son derece önemlidir. Zira her iki ilmin temellerini teşkil eden ve sonraki çalışmalara öncülük eden ilk eserler bu süreçte telif edilmeye başlanmıştır. Ulemâ, fıkhî bilgi üretmek için bir sistem geliştirme yoluna gitmiş, bu hususta ehl-i rey ile ehl-i hadîs olmak üzere iki temel farklı yaklaşım ön plana çıkmıştır. Bu bağlamda ehl-i rey mensubu ve Ebû Hanîfe’nin önde gelen öğrencilerinden olan Muhammed Şeybânî ile ehl-i hadîse yakın duran, Mâlik’in seçkin öğrencisi Şâfiî, mezkûr grupların yaklaşımlarını sentezlemeye çalışmışlardır. Diğer taraftan Şeybânî aracılığıyla Irâk fıkıh birikimine muttali olan Şâfiî ile Şeybânî’nin bazı hadis usulü konuları hakkındaki görüşleri arasında birtakım benzerlikler bulunmaktadır. Bu eybânî’nin el-Asl ile Şâfiî’nin el-Ümm adlı furû-i fıkıh kitaplarının hadis ilmi açısından mukayesesini konu almaktadır. Çalışmada Şeybânî’nin birçok konuda Şâfiî’ye öncülük ettiği, onun zihin dünyasını şekillendirdiği ve etkilediği tespit edilmiştir. Tezde, ilk olarak Şeybânî ile Şâfiî’nin hayatları ve eserleri hadis ilmi açısından tedkik edilmiş, ardından onların kendi eserleri üzerinden bazı hadis meseleleri hakkındaki görüşleri ve yaklaşımları ile sünnet anlayışları incelenerek iki âlim arasındaki irtibatın boyutları ve sonuçlarına dair bazı tespitler yapılmıştır. Böylece Şeybânî’nin Şâfiî üzerindeki tesiri ve onu hangi hususta ne kadar etkilediği tespit edilmeye çalışılmış, hadise yaklaşımları hususunda takip ettikleri yöntem ehl-i rey ile ehl-i hadîs anlayışları çerçevesinde mukayese edilip değerlendirilmiştir.

Hijri II. century is a period in which Islamic sciences and hadith science in particular were formed and started to develop. This period is extremely important especially in terms of hadith and fiqh sciences, since it is a century whin which mujtahid imams lived. Because the first works that formed the foundations of both sciences and pioneered the next studies started to be copyrighted in this process. Ulama chose to develop a system to produce fiqh knowledge, and in this regard, two basic different approaches came to the fore, namely ahl al-ray and ahl al-hadith. In this context, Muhammad Shaybani, a member of ahl al-ray and one of the prominent students of Abu Hanifa, and Shafii, an outstanding student of Malik, who was close to ahl hadith, tried to synthesize approaches of the aforementioned groups. On the other hand, there are some similarities between the views of Shafii, who had knowledge of Iraqi fiqh knowledge through Shaybani, and Shaybani's views on some hadith procedures.This doctoral thesis deals with the comparison of Shaybani's al-Asl and Shafii's al-Umm, in terms of hadith science. In the study, it has been determined that Shaybani led Shafi'i in many issues, shaped and influenced his mental world. In the thesis, firstly the lives and works of Shaybani and Shafii were examined in terms of the science of hadith, then some determinations were made about the dimensions and results of the contact between two scholars by examining their views and approaches on some hadith issues and their understanding of sunnah. Thus, it has been tried to determine the influence of Shaybani on Shafii and how much he affected him on what issue, and the method they followed in terms of hadith approaches was compared and evaluated within the framework of their understanding of ahl ray and ahl hadith.
