Kefilin sorumluluğunun kapsamı ve 6098 sayılı Türk borçlar kanunu ile yapılan değişiklikler

Abstract

Kefalet sözleşmesi, kefilin alacaklıya karşı, borçlunun borcunu ifa etmemesinin sonuçlarından kişisel olarak sorumlu olmayı üstlendiği bir sözleşmedir. Borçlunun borcunu ifa etmemesi sonucu kefil ödeme yapmak zorunda kalırsa, alacaklının haklarına halef olacaktır. Kefalet sözleşmesinin geçerli olması için yazılı şekilde yapılması ve kefil tarafından imzalanması lazımdır. Kefalet sözleşmesinde kefil, asıl borçlunun borcunu ödememesi halinde asıl borç ile birlikte onun yasal ve akdi faizlerinden de sorumlu olmayı taahhüt eder. Kefilin sorumluluğu, sözleşmeden ve kanundan kaynaklanır ve kefilin ödemeyi taahhüt ettiği azami miktar ile sınırlıdır.

Suretyship Contract is an agreement by which surety undertakes to be liable for the results of the debtor s default to the creditor. If the surety is required to pay or perform due to the debtor s default,he/she will be entitled to be subrogated to the rights of creditor. A contract of suretyship is enforce able only if it is in writing and signed by the surety. Surety promises to assume responsibility for the principal debt and its legal and contractual interests if the borrower defaults. The surety s liability arises from the contract or law and is limited to the maximum amount which the surety is undertaken to pay.
