Türk devrimi'nin hukuksal yönlerinin demokrasi bakımından değerlendirilmesi

Abstract

1919 yılında Kurtuluş Savaşı süreci ile başlayan ve 1930’lu yıllarda tekemmül ettiği kabul edilen Türk Devrimi’nin “hukuksal yönleri”nin ele alınması; bu vesileyle kapsadığı hukuk devrimlerinin, anayasal etkilerinin, hukuk sistemine dair sonuçlarının ve başkaca hususların irdelenmesinin yanı sıra, demokrasi ilkesi ve genel geçer demokrasi parametreleri bakımından, cumhuriyet ve demokrasi kavramları üzerinde de durularak değerlendirilmesi amaçlanmaktadır. Türkiye’deki sosyal bilimler literatüründe; özellikle 1970’ler sonrasında Türk Devrimi ve devrimin hedeflediği, meydana getirdiği siyasal rejim çokça tartışmalara konu olmuştur. Ancak yapılan bu tartışmaların pek çoğu bilimsel perspektiften uzak olup az sayıda bilimsel niteliği haiz olanlar ise ele alınan dönemi ve devrimleri sadece tarih yahut siyaset bilimi perspektifinden incelemiş, oldukça az bir kısmı da sosyolojik bir pencereden konuyu ele almıştır. Bu çalışmada ise tümevarım metodu ile ve hukuki bir perspektif takip edilmek suretiyle, öncelikle “devrim” – “cumhuriyet” – “demokrasi” – “hukuk” kavramları ele alınarak Türk Devrimi tüm hukuksal yönleriyle incelenecek ve bu vesileyle demokrasinin her boyutu yönünden değerlendirilecektir. Öte yandan, konu ele alınırken kaçınılmaz olarak Türk Devrimi’nin önderi ve başat ismi Mustafa Kemal Atatürk’ün devrimdeki, kurulan devletteki ve meydana gelen siyasal rejimdeki rolü, saiki, motivasyonu ve misyonu hususunda değerlendirme yapılacak ve demokratik-otoriter-totaliter rejim tiplerinin yanı sıra, Max Weber’in otorite-meşruiyet tipolojisi ve diktatörlük kavramı / söylemi üzerinde de (Makamın Antik Roma’daki pek bilinmeyen tarihsel arka planı da ele alınmak suretiyle) önemle durulacak ve günümüzde neyi ifade ettiği, modern hukuk devletlerinde bir karşılığının olup olmadığı tartışması yapılacaktır. Netice itibarıyla bu tezde, gerçekleştirildiği dönemden bugüne dek çokça bilimsel dezenformasyona ve algı yönetimlerine konu olan Türk Devrimi’ne; Kamu Hukuku açısından, hukuk biliminin perspektifiyle ve birçok önemli bilimsel kavram ve terimleri de (demokrasi, cumhuriyet, devrim, diktatörlük, otorite vb.) tanıyarak -tartışarak yaklaşmak ve devrim ile varılması hedeflenen “demokrasi” açısından devrimin etkilerinin ve getirilerinin tespit edilmesi amaçlanmaktadır. Bu sayede bilinmesi gerekli olan kavramların ve kuramların ışığında Türk Devrimi’ne objektif ve hukuksal bir perspektif bir mercek tutulmuş ve kaynaklar ışığında bütünlüklü bir değerlendirme yapılmış olacaktır.

The legal aspects of the Turkish Revolution, which started with the War of Independence in 1919 and is considered to have evolved in the 1930s, are discussed in the thesis; hereby, it is aimed to examine the legal revolutions it covers, its constitutional effects, its consequences on the legal system and other issues, as well as to evaluate them in terms of the principle of democracy and general democratic parameters, with an emphasis on the concepts of republic and democracy. The Turkish Revolution and the political regime it aimed and created have been the subject of much debate in the social sciences literature in Turkey, especially after the 1970s. However, mostly of these debates are far from a scientific perspective, and the few that have scientific methods have examined the period and revolutions only from the perspective of history or political science, and a very few of them have discussed the subject within the frame of the socialogical perspective. The Turkish Revolution will be examined in all its legal aspects by first considering in terms of revolution - republic -democracy - law, by following a legal perspective using the inductive reasoning and hereby, every aspect of democracy is going to be evaluated in this study. In addition to this, an evaluation is going to in inevitably be made regarding the role, motivation and mission of Mustafa Kemal Ataturk, the leader and dominant figure of the Turkish Revolution, in the revolution, the established state and the occuring political regime while discussing the subject and Max Weber's typologies of authority - legitimacy and the concept discourse of dictatorship (by also considering the little-known historical background from the Ancient Rome) as well as democratic -authoritarian - totalitarian regime types are going to be emphasized and a discussion is going to be made on what it means today and whether it has an equivalent in modern constituional states or not. In conclusion, this thesis focuses on the Turkish Revolution which has been the subject of much scientific disinformation and perception management from the time it was happened until today; it is aimed to approach it from the perspective of law as a science and by perceiving many important scientific concepts and terms (demoracy, republic, revolution, dictatorship, authority, etc.) in terms of Public Law and to determine & debate the effects and benefits of the revolution in terms of the democracy that is aimed to be achieved by the revolution. Thus, an objective and legal perspective is going to be put on the Turkish Revolution in the light of the concepts and theories that need to be known.
