Terörle mücadele kanununa göre terör suçlusu ve terör suçları (TMK md.2 ve md.3)

Abstract

TERÖRLE MÜCADELE KANUNUNA GÖRE TERÖR SUÇLUSU ve TERÖR SUÇLARI (TMK md.2 ve md.3) Terörle Mücadele Kanununa Göre Terör Suçlusu ve Terör Suçları (TMK md.2 ve md.3) konulu tezimizde, terörün tanımı, tarihçesi, nedenleri , TMK' nın 2. maddesinde yer alan terör suçlusutanımı ve TMK' nın 3. maddesinde yer alan terör suçları konuları incelenmiştir. 675 Sayılı Türk Ceza Kanunu'ndaki düzenlemelerle birlikte 5237 Sayılı Türk Ceza Kanunu'ndaki düzenlemeler konusunda da bilgiler verilerek, karşılaştırılmalar yapılmıştır. Bu karşılaştırmalarda temel olarak yasal düzenlemeler dikkate alınmış ve öğretideki tartışmalarla birlikte Yargıtay kararlarına değinilmiştir. Tezimizde, temel olarak vurguladığımız noktalar şunlardır: 1) Terör ifadesi, günümüzde yaygın olarak kullanılan bir kavram olmasına karşın, terörün ülkemizde 12.04.1991 tarihinde TMK kabul edilinceye kadar yerleşmiş bir tanımı yoktu. Terörü tanımlayabilmek için terörün amacının, nedenlerinin ve bütün boyutların dikkate alınması gerekmektedir. 2) Terör Suçlusu tanımına TMK' nın 2. maddesinde yer verilmiştir. Buna göre amaçlanan suçu işlemeseler dahi örgüte girerek mensubu olanlar da terör suçlusu sayılmaktadır. 3) TCK' da terör ile ilgili iki tür suç vardır. İşlendiği takdirde terör suçları ve terör amacıyla işlenen suçlar. Birinci tip suçta terör suçunun olması için suçun işlenmesi gereklidir. İkinci tip suçta ise suçun terör suçu sayılabilmesi için terör amacıyla işlenmesi gereklidir. 4) TMK' nın 3. maddesinde terör suçları belirtilmiştir. TCK' nın ilgili maddelerinde yer alan suçlar fail, maddi unsur, manevi unsur, özel görünüş şekilleri, ağırlatıcı ve hafifletici nedenleri bakımından incelenmiştir TERROR CRIMINAL AND TERROR CRIMES ACCORDING TO THE PREVENTION OF TERRORISM ACT (PTA ar.2 and ar.3) In our thesis about Terror Criminal and Terror Crimes According to The Prevention of Terrorism Act (PTA ar.2 and ar.3), the definition of terror, its history, reasons, the terror criminal definition at the 2. Article of PTA and terror crimes subjects at the 3. Article of the PTA have been examined. Information has been given on arrangements on Turkish Criminal Code No 5237 along with the arrangements on Turkish Criminal Code No 675, and comparisons have been made. In these comparisons, basically the legal arrangements are taken into consideration and the decisions of the Supreme Court are mentioned together with the discussions in the discipline. The points that are basically emphasized at our thesis are as follows: 1) The terror expression, although it is a common used expression in present, there was not an established definition of terror in our country until PTA was accepted at 12.04.1991. To define terror, the aim of the terror, reasons and all dimensions must be taken into consideration. 2) The definition of Terror Criminal is given in the 2. Article of the PTA. According to this the persons who have been a member of the organization are considered as terror criminals even though they have not committed the intended crime. 3) There are two types of crime in TCC. The terror crimes if committed and crimes committed with the aim of terror. In the first type of crime, to have a terror crime, the crime must be committed. But in the second type of crime the crime must be committed with the aim of terror to be accepted as a terror crime. 4) The terror crimes are mentioned in the 3. Article of PTA. The crimes that are in the relevant articles of the TCC are examined from the aspects of perpetrator, corpus delicti, moral factor, special appearance types and extenuating circumstances.
