Abstract
Yakın geçmişte ülkemizde sık sık meydana gelen terör saldırıları ve toplum vicdanını yaralan olaylar neticesinden yayın yasakları konusu herkes tarafından bilinen ve tartışılan bir uygulama haline geldi. Mahkemelerce verilen yayın yasaklarının yanı sıra, Cumhurbaşkanı’na verilen geçici yayın yasağı getirme yetkisi her uygulandığında beraberinde özgür basına müdahale ediliyor tepkilerine yol açmıştır. Bu çalışma ile Cumhurbaşkanlığı tarafından getirilen yayın yasaklarının kitle iletişim özgürlüğü çerçevesinde hangi noktada konumlandığını, hak ve özgürlükler üzerindeki etkisi incelenmiştir. Yasanın çıktığı tarihten itibaren 9 kez kullanılan bu yetkinin, genel olarak kitle iletişim özgürlüğüne herhangi bir olumsuz etkisi olmadığı görülürken, bir kısım kararın bu özgürlüğü kısıtlayıcı etki yaptığı görülmüştür.
In the recent past, the terrorist attacks occurring frequently in our country and the issue of broadcasting bans on the consequences of the events that hurt the conscience of society have become an application known and discussed by everyone. In addition to the broadcasting bans issued by the courts, whenever the authority given to the President so as to bring provisional broadcasting ban is applied, such situation has led to reactions regarding that intervention has been made to free press. In this study, the rights and freedoms have been examined at which point the broadcast bans brought by the presidency were positioned within the framework of freedom of mass communication. This authority, which has been used 9 times since the enactment date of the law, has not had any adverse effects on the freedom of mass communication in general, but a part of the decision has been seen to have a restrictive effect on this freedom.
