Fıkıh usulünde mefhumun delaleti ile ilgili kavramların gelişimi

Abstract

Delalet, Mantûk, Mefhûm, Mefhûmu’l-muvafaka, Mefhûmu’l-muhalefe ÖZET FIKIH USULÜNDE MEFHÛMUN DELÂLETİ İLE İLGİLİ KAVRAMLARIN GELİŞİMİ Fıkıh alimleri Kitap, Sünnet ve icma’ delillerinden mükellefin fiillerinin şer’î hükümlerini ortaya koymaya çalışırken, fıkıh usulü de deliller ve hükümlerin niteliklerini, bu delillerden söz konusu hükümlerin nasıl çıkarıldığını veya nasıl çıkarılacağını, hitabın bu hükümlere delaletinin şekillerini tesbit etmeye çalışmıştır. Dolayısıyla fıkıh usulünün ele aldığı önemli konulardan biri de hitabın hükme delalet şekilleridir. Bu çalışma usulcülerin, hitabın hükme delalet şekillerinden mefhûmun delaletini nasıl ortaya koyduklarının gelişimini konu edinmiştir. Giriş ve üç bölümden oluşan çalışmamızın birinci bölümünde hitabın delaletine dair kavramsal çerçeve tanıtılmaya çalışılmış; bu bağlamda delalet, delil ve medlûl kavramları ile hitabın delalet şekillerinden mantûkun delaleti incelenmiştir. Mantûkun sarih delaleti başlığı altında nass ve zahir, gayr-i sarih delaleti başlığı altında da işaretin delaleti, imânın delaleti ve iktizanın delaleti kavramları işlenmiştir. İkinci bölümde başta mefhûm kavramı üzerinde durulmuş, sonra da mefhûmun kısımlarından, Hanefî usulcülerin nassın delaleti, diğer usulcülerin ise fahve’l-hitap veya mefhûmu’l-muvafaka dedikleri delalet türü ve kısımları ile ilgili kavramlar incelenmiştir. Çalışmamızın üçüncü bölümünde ise mefhûmun diğer bir türü olan ve geçerli bir delalet şekli olup olmadığı konusunda usulcüler arasında derin tartışmalara konu olan mefhûmu’l-muhalefe, türleri, hücciyeti, buna dair ileri sürdükleri gerekçeler ve alakalı diğer konularla ilgili kavramlar ele alınmıştır. THE EVOLUTION OF TERMS RELATED TO INDICATION OF IMPLIED MEANING (DALÂLA AL-MAFHÛM) IN ISLAMIC LEGAL THEORY While the Fuqaha derived rules from the Quran, Sunnah and ijma based on these proofs, legal theory (usul al-fiqh) focuses on studying these texts as well as the precedents set by past rulings. Thereby, one of purposes of usul al fiqh is to explain how the compellaton relate to the jurisprudence that is put in practice. The focus of this study is to explain how the Muslim jurists use the implication of compellaton to understand the implied meaning (mefhûm) among the other kind of studies of the meaning. This study consists of an introduction and three chapters. The first chapter discusses the conceptual framework of types of the meaning that can be derived from the implication of compellatton. İn this context proof (dalîl), inferred (madlûl) and what textual implications (dalâlat) concepts and the explicit meaning (mantûk) were exercised. Under the title of the explicit indication of the saying, nass/ definite (in meaning) and zahir/ apparent (meaning); under the non-explicit indication has been processed the indication of allude (dalala al ishârah), the indication of hint (dalala al îmâ) and the indication of require (dalala al iqtizâ). The second section focuses primarily on the meaning (mefhum) concept and on one of its part. Which the scholars of the Hanefi school named it the indication of the definite dalalah al-nass, while the others call it fahve’l- hitap or mefhumu’l- muvafakat. In the third section of the study discussed the divergent meaning (mefhûmu’l-muhalefe )- which is the one of the other kind of the implied meaning- its kinds, its evaluations, the discussions has been made around it.
