Publication: Fransız ve Türk medeni yargılama hukuklarında temyiz mahkemesinin yapısı ve işlevi
Abstract
Fransız ve Türk Temyiz Mahkemelerinin Yapısı ve İşlevini ve konu alan çalışmanın amacı, iki hukuk sistemindeki temyiz mahkemelerinin dayandığı esasları izah etmek, temyiz mahkemesinin karakteri ile ilgili ortaya çıkan tartışmalı noktaları değerlendirmektir. Çalışma, dört bölümden oluşmaktadır. İlk bölümde temyiz kanun yolunun ve temyiz mahkemelerinin tarihçesi ile temyiz kanun yolunun unsurları üzerinde durulmuştur. Fransız hukukunda kanun yolunun unsurları konusunda kabul edilen esaslar Türk hukuku için de ayrıca değerlendirilmiştir.
The thesis which deals with the structure and function of the courts of cassations, tries to introduce the theoretical essentials where the courts of cassations are based and assess the problematic points on the character of the courts of cassations. The thesis consists of four chapters. First chapter embraces the history of cassation, the courts of cassation and the principles of cassation. We emphasized the principles of cassation in French law in order to appreciate it for the Turkish system.
