Türk iş hukukunda işyeri sendika temsilciliği ve işçi kuruluşu yöneticiliği

Abstract

İşçi kuruluşu yöneticisi ve işyeri sendika temsilcisi sendikacılığın gelişmesinde çok önemli görevleri yerine getiriler. İşçi kuruluşu yöneticisi sendikanın amacını gerçekleştirebilmesi için her türlü hukuki işlemi yapabilirken işyeri sendika temsilcisi sendikayı işyerinde etkin bir biçimde temsil etmektedir. Bunun sonucu olarak da işverenlerin menfaatlerine aykırı eylem ve işlemlerde bulunmaları kaçınılmazdır. Bu sebeple de diğer işçilerden daha fazla korunmaya ihtiyaç duyarlar. Kanun koyucu onlar için daha etkili bir güvence sistemi getirmiştir. Tezimizde işyeri sendika temsilcileri ve işçi kuruluşu yöneticileri, özel olarak getirilmiş güvence hükümleri başta olmak üzere tüm yönleriyle ele alınmıştır.

Labor institution managers and workplace union representatives perform duties that are very important for development of unionism. While a labor institution manager carries out all types of legal procedures to enable the union to achieve its goals, a workplace union representative is an individual who effectively represents the union at the workplace. Consequently, it is unavoidable for such people to take actions and perform procedures that are against the interests of employers. Due to this, managers and representatives need a higher level of protection than other workers. Law-makers have provided them with a more effective security system. Our thesis analyzes labor institution managers and workplace union representatives with special focus on the provided regulations for protection.
