Publication: Köleliğin evrimi ve modern devlette görünümü
Abstract
Bu çalışmanın ilk bölümünde, sosyal ve siyasal antropolojik veriler ışığında köleliğin ilk örneklerinin nasıl ortaya çıkmış olabileceği ele alınmıştır. Ardından devlet teorisi ve hukuk tarihi verileri kullanılarak, meşru ve hukuki bir zemine sahip olan klasik kölelik uygulamalarının, farklı devlet ve hukuk sistemlerinde nasıl karşılık bulduğu incelenmiştir. İkinci bölümde, ekonomik iktidarın siyasal iktidarı belirlemeye başladığı, modern devletin ve insan haklarının ortaya çıkışına sahne olan tarihsel süreç paralelinde köleliğin evrimi incelenmiştir. Ardından, köleliğin modern hukuk sistemlerinde köleliğin sonlandırılması yönündeki ulusal ve uluslararası çabalar ortaya konulmaya çalışılmıştır. Çalışmanın üçüncü bölümünde ise, kuramsal ve kavramsal bir incelemeye tabi tutularak incelenen modern kölelik olgusu tanımlanmaya çalışılmıştır. Çalışma, bu tanım çerçevesinde modern köleliğin farklı görünüm biçimleri ile somutlaştırılarak sonlandırılmıştır.
In the first part of this study, in the light of anthropological data, it is discussed how the first examples of slavery may have emerged from the perspective of theoretical human rights. Then, using state theory and legal history data, it was examined how the classical slavery practices, which had a legitimate and legal basis, corresponded to different state and legal systems. In the second part of the study, the evolution of slavery has been examined in parallel with the historical process in which the economic power began to determine the political power and the emergence of the modern state and human rights. Then, national and international efforts to end slavery in modern legal systems have been tried to be put forward. In the third part of the study, the phenomenon of modern slavery, which was examined by subjecting it to a theoretical and conceptual analysis, was tried to be defined. The study was concluded by embodying the different appearance forms of modern slavery within the framework of this definition.
