Sağlıkta dönüşümden sonra sağlık çalışanı haklarına yönelik düzenlemeler

Abstract

Tez çalışmamız sağlıkta dönüşümden sonra sağlık çalışanı haklarına yönelik düzenlemelerin neler olduğunun ortaya konulabilmesi amacı ile yapılmıştır. Çalışmada açık amaç, özellikle insana yakışır iş kavramının önemli hâle geldiği yeni binyıl değişiminin, Türkiye’de sağlık çalışanı haklarına yönelik sonucunu saptamaktır. Tez çalışması, çalışan haklarına yönelik olarak, sosyal koruma, sosyal diyalog, üretken istihdam ile çalışan sağlığı ve güvenliği alanlarında, konu temelli inceleme usulü ile yürütülmüştür. Çalışma, yeni binyıl insana yakışır iş kavramından çok önce, gerek ulusal gerekse ulusal üstü düzenlemeleri de içererekten gerçekleştirilmiştir. Çalışmamız sonucunda elde ettiğimiz ilk bulgu, Türkiye Devleti’nin çalışan haklarına yönelik düzenlemeleri zaman zaman salt Yürütme’nin iradesi ile çoğu zaman da Uluslararası Çalışma Örgütü ya da Avrupa Konseyi metinlerine uyarlama çerçevesinde oluşturduğudur. Türkiye’nin, insana yakışır iş kavramının dört unsurundan her birini, belirli zaman dilimlerinde gözettiği ve düzenlediği çalışmamız sonucunda ortaya konulmuştur. Türkiye, sosyal koruma ile çalışan sağlığı ve güvenliği alanında gerekli düzenlemeleri evrensel ölçekte gerçekleştirken, üretken istihdam ve sosyal diyalog anlamında düzenlemelerini insana yakışır iş ölçütünde tamamlayamamıştır. Bahis konusu durum, sağlık çalışanı haklarına yönelik de aynı gerçeği sonuçlamıştır. Birleşmiş Milletler Örgütünün Binyıl Kalkınma Hedeflerinin önemli girdisi olan sağlık konusu, Türkiye’de de sağlık çalışanı haklarının özenle gözetilmesini talep etmektedir.

Our thesis, has been prepared in order to reveal the legal regulations made regarding the rights of healthcare professionals after the initialization of the Healthcare Reform in Turkey. The primary purpose of this research is determining the effects these transformations had on the healthcare professionals’ rights in Turkey, as concerns over conditions of decent work rose considerably with the coming of a new millennium. The research has been conducted on concepts of social protection, social dialogue, and promoting employment and occupational health and safety ultimately concerning workers' rights. The study has been prepared to incorporate both the national and universal regulations that take place way before the conceptualization of the term decent work the new millennium brought about. The first finding our study has revealed is that the regulations Turkish Government made concerning workers' rights has been mostly formed, sometimes of the Executive Power's own volition, as an adaptation to the International Labour Organization and the European Council. Through our research, it has been presented that each of the four aspects of the term decent work has been taken into consideration and configured in certain time frames respectively. Turkey, implementing the necessary regulations on social protection and occupational health and safety in a universal scale, has nevertheless failed in the regulations about promoting employment and social dialogue over the standards of decent work. The situation in question has also resulted in this very same reality for the rights of healthcare professionals. The subject of medicine, which itself is a significant point of entry in the Millennium Development Goals of the United Nations, demands the rights of healthcare professionals to be monitored meticulously in Turkey as well.
