ISO 14001 çevre yönetim sisteminin yasal mevzuat ile uyumu

Abstract

ISO 14001 ÇEVRE YÖNETİM SİSTEMİNİN YASAL MEVZUAT İLE UYUMU Bu tez çalışmasında ise, Türkiye’ de geçerli olan kanun, tüzük, yönetmelik ve bunlarla ilgili yasal yetki ve sorumluluklar ele alınarak, bu yetki ve sorumlulukların ISO 14001 Çevre Yönetim Sistemleriyle ne kadar uyumlu oldukları gösterilmiştir. Çevre Yönetim Sistemlerinin bir özeti yapılmış, daha sonra bu yönetim sistemlerinin gerektirdiği sorumlu kişiler, eğitim, emisyonun azaltılması, risk analizi ve ruhsatlandırmayla ilgili zorunlulukların aslında yasaların da zorunlu tuttuğu işler, işlemler olduğu gösterilmiştir. Bilindiği gibi çevre sağlığı, halk sağlığı, iş güvenliği ve çalışan sağlığı kavramları birbirlerinden farklı olmakla birlikte aynı zamanda birbirleri ile çok ilişkili kavramlardır. Çevre Yönetim Sistemiyle ilgili yasalar incelenirken uyulması gerekli yasal düzenleyicilerin yalnız çevre ile ilgili olanlar değil, halk sağlığı, iş güvenliği ve sağlığı ile ilgili olanları da kapsadığı gösterilmiştir, çünkü bu tür yasa, tüzük ve yönetmeliklerde de çevreyle ilgili atıflar bulunmaktadır. Bu şekilde Türkiye ‘de yaygın olarak söylenen Çevre Yönetim Sistemlerinin “yasalardan bağımsız olduğu” ve “çevre yönetim sistemleri açısından firmaların yalnız kendi taahhütleriyle bağlı olduğu” konusundaki gizli ve üstü kapalı söylemin geçersizliği ve Çevre Yönetim Sistemlerinin ruhuna uymadığı gösterilmeye çalışılmıştır. Birçok şirket kanuni zorunlulukları yerine getirme sebebiyle çevre ile ilgili veya çevresel boyutları olan faaliyetleri ile ilgili prosedürler oluşturarak bu faaliyetleri kontrol altına alan Çevre Yönetim Sistemlerini uygulamaya çalışmıştır. Uygulanmaya çalışılan bu sistemler bazı özel çevresel değerlendirme tekniklerini kapsamaktadır. Örnek vermek gerekirse, Risk ve Sonuç Analizi; hem kanuni bir zorunlulukken hem de Çevre Yönetim Sisteminin uygulama ve işlem esaslarındandır. Kuruluşların faaliyetlerinin yürürlükteki çevre mevzuatına uygunluğu yasal bir zorunluluk olup, kuruluşlarda bu yasal zorunluluğa uymak adına faaliyetleri ile mevzuatlar arasında ki uygunluğu belirli aralıklarla gözden geçirmek için belgeye bağlı usuller koymalı ve bunların idamesini sağlamalıdır.

ACCORDANCE OF ISO 14001 ENVIRONMENTAL MANAGEMENT SYSTEM WITH LEGAL PROVISIONS In this thesis; by giving emphesis to responsibities and legal authorisations which are related with regulations and rules, that are being applied in Turkey; it is managed to be shown as, how these authorisations and responsibities are being cordinated with ISO 14001 Environment Management Systems. Firstly; the summary of Environment Management System has been done, than it’s been shown that the obligations about responsibles that were required by the management system, the education decrasement of emission,the risk analysee and licenses are; infact the works and procedures are obligatories by the laws. As it‘s known; although the environment health,public health, work-safety and workers’ health concepts are really all different from each other, besides; they are related concepts close to each other. While the laws are being examinated about The Environment Management System, it‘s been shown as; not only the regulations that must be obeyed about the environment; it also includes the regulations about the work safety, work health,and the public health. Because there are also some references to the environment ,with these kinds of laws and regulations. By this way, it was managed to be implied, and some of the secret announcements that were generally been told in Turkey, as ”The firms are bounded with just by their own contracts about the environment management systems and they are independent from laws”. These are all invalid and do not suit to the soul of The Environment Management Systems. As a result of some legal exigencies, most of companies bring in some Environmental Management Systems requires ecological and/ or some procedures includes ecological operations to constitute to control these activities. These systems include some special environmental evalution techniques. As an example; Risk and Conclusion Analyses is not only a statutory obligation but also an element of Environmental Management System in use of both operation and processing. Compability of line of activities of these companies are statutory obligation and -result of these obligation- companies must proceed some requirements to control the appropriateness between their activies and legal provisions
